(1) For deposit in the water quality initiative 32 fund created in section 466B.45 for purposes of 33 supporting the water quality initiative administered by 34 the soil conservation division as provided in section 35 466B.42, including salaries, support, maintenance, and 36 miscellaneous purposes: 37 FY 2015-2016: 38 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 3,100,000 39 (2) (a) The moneys appropriated in this lettered 40 paragraph shall be used to support projects in 41 subwatersheds as designated by the department that 42 are part of high-priority watersheds identified by 43 the water resources coordinating council established 44 pursuant to section 466B.3. 45 (b) The moneys appropriated in this lettered 46 paragraph shall be used to support projects in 47 watersheds generally, including regional watersheds, as 48 designated by the division and high-priority watersheds 49 identified by the water resources coordinating council 50 -8- HF650.1868 (3) 86 ec/tm 8/ 16
established pursuant to section 466B.3. 1 (3) In supporting projects in subwatersheds and 2 watersheds as provided in subparagraph (2), all of the 3 following shall apply: 4 (a) The demonstration projects shall utilize water 5 quality practices as described in the latest revision 6 of the document entitled “Iowa Nutrient Reduction 7 Strategy” initially presented in November 2012 by 8 the department of agriculture and land stewardship, 9 the department of natural resources, and Iowa state 10 university of science and technology. 11 (b) The division shall implement demonstration 12 projects as provided in subparagraph division (a) by 13 providing for participation by persons who hold a legal 14 interest in agricultural land used in farming. To 15 every extent practical, the division shall provide for 16 collaborative participation by such persons who hold a 17 legal interest in agricultural land located within the 18 same subwatershed. 19 (c) The division shall implement a demonstration 20 project on a cost-share basis as determined by the 21 division. However, the state’s share of the amount 22 shall not exceed 50 percent of the estimated cost of 23 establishing the practice as determined by the division 24 or 50 percent of the actual cost of establishing the 25 practice, whichever is less. 26 (d) The demonstration projects shall be used to 27 educate other persons about the feasibility and value 28 of establishing similar water quality practices. The 29 division shall promote field day events for purposes of 30 allowing interested persons to establish water quality 31 practices on their agricultural land. 32 (e) The division shall conduct water quality 33 evaluations within supported subwatersheds. Within 34 a reasonable period after accumulating information 35 from such evaluations, the division shall create an 36 aggregated database of water quality practices. Any 37 information identifying a person holding a legal 38 interest in agricultural land or specific agricultural 39 land shall be a confidential record under section 22.7 . 40 (4) The moneys appropriated in this lettered 41 paragraph shall be used to support education and 42 outreach in a manner that encourages persons who 43 hold a legal interest in agricultural land used for 44 farming to implement water quality practices, including 45 the establishment of such practices in watersheds 46 generally, and not limited to subwatersheds or 47 high-priority watersheds. 48 (5) The moneys appropriated in this lettered 49 paragraph may be used to contract with persons to 50 -9- HF650.1868 (3) 86 ec/tm 9/ 16
coordinate the implementation of efforts provided in 1 this paragraph. 2 (6) The moneys appropriated in this lettered 3 paragraph may be used by the department to support 4 urban soil and water conservation efforts, which may 5 include but are not limited to management practices 6 related to bioretention, landscaping, the use of 7 permeable or pervious pavement, and soil quality 8 restoration. The moneys shall be allocated on a 9 cost-share basis as provided in chapter 161A. 10 (7) Notwithstanding any other provision of 11 law to the contrary, the department may use moneys 12 appropriated in this lettered paragraph to carry out 13 the provisions of this paragraph on a cost-share basis 14 in combination with other moneys available to the 15 department from a state or federal source. 16 (8) Not more than 10 percent of the moneys 17 appropriated in this lettered paragraph may be used 18 for costs of administration and implementation of the 19 water quality initiative administered by the soil 20 conservation division. 21 b.
