AGRICULTURAL EDUCATION. 13 1. FARMERS WITH DISABILITIES PROGRAM. 32 1. The moneys appropriated in subsection 1 shall 42 be used for the public purpose of providing a grant to 43 a national nonprofit organization with over 80 years 44 of experience in assisting children and adults with 45 disabilities and special needs. The moneys shall 46 be used to support a nationally recognized program 47 that began in 1986 and has been replicated in at 48 least 30 other states, but which is not available 49 through any other entity in this state, and that 50 -3- SF494.1870.H (2) 86 md 3/ 30
provides assistance to farmers with disabilities in 1 all 99 counties to allow the farmers to remain in 2 their own homes and be gainfully engaged in farming 3 through provision of agricultural worksite and home 4 modification consultations, peer support services, 5 services to families, information and referral, and 6 equipment loan services. 7 3. Notwithstanding section 8.33 , moneys 8 appropriated in this section that remain unencumbered 9 or unobligated at the close of the fiscal year shall 10 not revert but shall remain available for expenditure 11 for the purposes designated until the close of the 12 succeeding fiscal year. 13 Sec. 8. AVIAN FLU STUDY. 14 1. There is appropriated from the general fund of 15 the state to the department of agriculture and land 16 stewardship for the fiscal year beginning July 1, 2014, 17 and ending June 30, 2015, the following amount, or 18 so much thereof as is necessary, to be used for the 19 purposes designated: 20 For determining the cause and spread of any virus 21 commonly referred to as avian influenza as transmitted 22 to domesticated fowl: 23 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 50,000 24 2. EFFECTIVE UPON ENACTMENT. The section 32 of this division of this Act appropriating moneys 33 for determining the cause and spread of any virus 34 commonly referred to as avian influenza, being deemed 35 of immediate importance, takes effect upon enactment. 36 DIVISION II 37 GENERAL FUND 38 DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 39 WATER QUALITY INITIATIVE 40 APPROPRIATIONS FOR FY 2015-2016 41 Sec. 10. WATER QUALITY INITIATIVE —— GENERAL. 42 1. There is appropriated from the general fund of 43 the state to the department of agriculture and land 44 stewardship for the fiscal year beginning July 1, 2015, 45 and ending June 30, 2016, the following amount, or 46 so much thereof as is necessary, to be used for the 47 purposes designated: 48 For deposit in the water quality initiative fund 49 created in section 466B.45 , for purposes of supporting 50 -4- SF494.1870.H (2) 86 md 4/ 30
the water quality initiative administered by the 1 soil conservation division as provided in section 2 466B.42 , including salaries, support, maintenance, and 3 miscellaneous purposes: 4 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 4,400,000 5 2. a. The moneys appropriated in subsection 1 6 shall be used to support projects in subwatersheds 7 as designated by the division that are part of 8 high-priority watersheds identified by the water 9 resources coordinating council established pursuant to 10 section 466B.3 . 11 b. The moneys appropriated in subsection 1 shall 12 be used to support projects in watersheds generally, 13 including regional watersheds, as designated by the 14 division and high-priority watersheds identified by 15 the water resources coordinating council established 16 pursuant to section 466B.3. 17 3. In supporting projects in subwatersheds and 18 watersheds as provided in subsection 2, all of the 19 following shall apply: 20 a. The demonstration projects shall utilize water 21 quality practices as described in the latest revision 22 of the document entitled “Iowa Nutrient Reduction 23 Strategy” initially presented in November 2012 by 24 the department of agriculture and land stewardship, 25 the department of natural resources, and Iowa state 26 university of science and technology. 27 b. The division shall implement demonstration 28 projects as provided in paragraph “a” by providing for 29 participation by persons who hold a legal interest in 30 agricultural land used in farming. To every extent 31 practical, the division shall provide for collaborative 32 participation by such persons who hold a legal 33 interest in agricultural land located within the same 34 subwatershed. 35 c. The division shall implement a demonstration 36 project on a cost-share basis as determined by the 37 division. However, the state’s share of the amount 38 shall not exceed 50 percent of the estimated cost of 39 establishing the practice as determined by the division 40 or 50 percent of the actual cost of establishing the 41 practice, whichever is less. 42 d. The demonstration projects shall be used to 43 educate other persons about the feasibility and value 44 of establishing similar water quality practices. The 45 division shall promote field day events for purposes of 46 allowing interested persons to establish water quality 47 practices on their agricultural land. 48 e. The division shall conduct water quality 49 evaluations within supported subwatersheds. Within 50 -5- SF494.1870.H (2) 86 md 5/ 30
a reasonable period after accumulating information 1 from such evaluations, the division shall create an 2 aggregated database of water quality practices. Any 3 information identifying a person holding a legal 4 interest in agricultural land or specific agricultural 5 land shall be a confidential record under section 22.7 . 6 4. The moneys appropriated in subsection 1 shall 7 be used to support education and outreach in a manner 8 that encourages persons who hold a legal interest in 9 agricultural land used for farming to implement water 10 quality practices, including the establishment of such 11 practices in watersheds generally, and not limited to 12 subwatersheds or high-priority watersheds. 13 5. The moneys appropriated in subsection 1 may 14 be used to contract with persons to coordinate the 15 implementation of efforts provided in this section. 16 6. The moneys appropriated in subsection 1 may 17 be used by the department to support urban soil and 18 water conservation efforts, which may include but 19 are not limited to management practices related to 20 bioretention, landscaping, the use of permeable or 21 pervious pavement, and soil quality restoration. The 22 moneys shall be allocated on a cost-share basis as 23 provided in chapter 161A. 24 7. Notwithstanding any other provision of law 25 to the contrary, the department may use moneys 26 appropriated in subsection 1 to carry out the 27 provisions of this section on a cost-share basis 28 in combination with other moneys available to the 29 department from a state or federal source. 30 8. Not more than 10 percent of the moneys 31 appropriated in this section may be used to pay 32 for the costs of administering and implementing the 33 water quality initiative by the department’s soil 34 conservation division as provided in section 466B.42 35 and this section. 36 DIVISION III 37 DEPARTMENT OF NATURAL RESOURCES 38 GENERAL APPROPRIATIONS FOR FY 2015-2016 39 Sec. 11. GENERAL FUND —— DEPARTMENT. 40 1. STATE FISH AND GAME PROTECTION FUND —— 20 REGULATION AND ADVANCEMENT OF OUTDOOR ACTIVITIES. 21 1. There is appropriated from the state fish and 22 game protection fund to the department of natural 23 resources for the fiscal year beginning July 1, 2015, 24 and ending June 30, 2016, the following amount, or 25 so much thereof as is necessary, to be used for the 26 purposes designated: 27 For purposes of supporting the regulation or 28 advancement of hunting, fishing, or trapping, or the 29 protection, propagation, restoration, management, 30 or harvest of fish or wildlife, including for 31 administration, regulation, law enforcement, and 32 programs; and for salaries, support, maintenance, 33 equipment, and miscellaneous purposes: 34 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 41,223,225 35 2. VETERINARY DIAGNOSTIC LABORATORY. 16 1. IOWA NUTRIENT RESEARCH CENTER. 47 1. DATA COLLECTION OF IN-FIELD AGRICULTURAL 13 PRACTICES —— THREE-YEAR PILOT PROJECT. 14 1. Notwithstanding section 455E.11, subsection 2, 15 paragraph b, subparagraph (3), subparagraph division 16 (b), of the unobligated and unencumbered moneys 17 remaining in the agriculture management account of the 18 groundwater protection fund that would otherwise be 19 required to be transferred to the Iowa department of 20 public health under that subparagraph division, there 21 is appropriated to Iowa state university of science 22 and technology for the fiscal year beginning July 1, 23 2015, and ending June 30, 2016, the following amount, 24 or so much thereof as is necessary, to be used for the 25 purposes designated: 26 a. For use by the university’s college of 27 agriculture and life sciences for purposes of 28 supporting a three-year data collection of in-field 29 practices project: 30 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 1,230,000 31 b. The three-year project shall be used to do all 38 of the following: 39 a. Enhance this state’s ability to track its 40 progress in reducing the transport of nutrients to 41 water from nonpoint sources within watersheds in 42 accordance with the latest revision of the document 43 entitled “Iowa Nutrient Reduction Strategy” initially 44 presented in November 2012 by the department of 45 agriculture and land stewardship, the department of 46 natural resources, and Iowa state university of science 47 and technology. 48 b. Develop a database of in-field agricultural 49 practices and analyze the impact of those practices 50 -10- SF494.1870.H (2) 86 md 10/ 30
in the aggregate. An agricultural practice includes 1 but is not limited to soil and water conservation 2 practices, structures, technologies, and agricultural 3 inputs and outputs. The college may also provide 4 for the measurement of other impacts associated with 5 agricultural production. The finding of the pilot 6 project shall be used to develop a system to be 7 implemented within a broader range of watersheds that 8 measures existing agricultural practices and the impact 9 of different nutrient management decisions. 10 3. The college shall enter into a private-public 11 partnership with one or more persons responsible for 12 receiving, collecting, or holding data described in 13 subsection 2. The college shall provide for the terms 14 and conditions of any legal or financial arrangement 15 that it enters into with such person. Any information 16 received, collected, or held by the person shall 17 be confidential in the same manner as provided in 18 section 466B.49, subsection 2. The college shall 19 only enter into an arrangement with a person if the 20 college is satisfied that the person will protect the 21 confidentiality of the information. Any information 22 including aggregate data transmitted to the college by 23 the person shall be available for public examination 24 and copying under chapter 22, except for the same type 25 of information described in section 466B.49, subsection 26 2, which shall remain confidential. 27 4. The college shall submit interim reports to the 28 general assembly by March 1, 2016, and March 1, 2017, 29 and a final report to the general assembly by March 1, 30 2018. The final report shall include its findings and 31 recommendations. 32 DIVISION V 33 ENVIRONMENT FIRST FUND 34 GENERAL APPROPRIATIONS FOR FY 2015-2016 35 Sec. 20. The moneys shall 23 be used to support a nationally recognized program 24 that began in 1986 and has been replicated in at 25 least 30 other states, but which is not available 26 through any other entity in this state, and that 27 provides assistance to farmers with disabilities in 28 all 99 counties to allow the farmers to remain in 29 their own homes and be gainfully engaged in farming 30 through provision of agricultural worksite and home 31 modification consultations, peer support services, 32 services to families, information and referral, and 33 equipment loan services. 34 3. Notwithstanding section 8.33 , moneys 35 appropriated in this section that remain unencumbered 36 or unobligated at the close of the fiscal year shall 37 not revert but shall remain available for expenditure 38 for the purposes designated until the close of the 39 succeeding fiscal year. 40 DIVISION IX 41 GENERAL FUND 42 DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 43 WATER QUALITY INITIATIVE 44 APPROPRIATIONS FOR FY 2016-2017 45 Sec. 32. WATER QUALITY INITIATIVE —— GENERAL. 46 1. The moneys appropriated in subsection 1 10 shall be used to support projects in subwatersheds 11 as designated by the division that are part of 12 high-priority watersheds identified by the water 13 resources coordinating council established pursuant to 14 section 466B.3 . 15 b. The moneys appropriated in subsection 1 shall 16 be used to support projects in watersheds generally, 17 including regional watersheds, as designated by the 18 division and high-priority watersheds identified by 19 the water resources coordinating council established 20 pursuant to section 466B.3. 21 3. In supporting projects in subwatersheds and 22 watersheds as provided in subsection 2, all of the 23 following shall apply: 24 a. The demonstration projects shall utilize water 25 quality practices as described in the latest revision 26 of the document entitled “Iowa Nutrient Reduction 27 Strategy” initially presented in November 2012 by 28 the department of agriculture and land stewardship, 29 the department of natural resources, and Iowa state 30 university of science and technology. 31 b. The division shall implement demonstration 32 projects as provided in paragraph “a” by providing for 33 participation by persons who hold a legal interest in 34 agricultural land used in farming. To every extent 35 practical, the division shall provide for collaborative 36 participation by such persons who hold a legal 37 interest in agricultural land located within the same 38 subwatershed. 39 c. The division shall implement a demonstration 40 project on a cost-share basis as determined by the 41 division. However, the state’s share of the amount 42 shall not exceed 50 percent of the estimated cost of 43 establishing the practice as determined by the division 44 or 50 percent of the actual cost of establishing the 45 practice, whichever is less. 46 d. The demonstration projects shall be used to 47 educate other persons about the feasibility and value 48 of establishing similar water quality practices. The 49 division shall promote field day events for purposes of 50 -20- SF494.1870.H (2) 86 md 20/ 30
allowing interested persons to establish water quality 1 practices on their agricultural land. 2 e. The division shall conduct water quality 3 evaluations within supported subwatersheds. Within 4 a reasonable period after accumulating information 5 from such evaluations, the division shall create an 6 aggregated database of water quality practices. Any 7 information identifying a person holding a legal 8 interest in agricultural land or specific agricultural 9 land shall be a confidential record under section 22.7 . 10 4. The moneys appropriated in subsection 1 shall 11 be used to support education and outreach in a manner 12 that encourages persons who hold a legal interest in 13 agricultural land used for farming to implement water 14 quality practices, including the establishment of such 15 practices in watersheds generally, and not limited to 16 subwatersheds or high-priority watersheds. 17 5. The moneys appropriated in subsection 1 may 18 be used to contract with persons to coordinate the 19 implementation of efforts provided in this section. 20 6. The moneys appropriated in subsection 1 may 21 be used by the department to support urban soil and 22 water conservation efforts, which may include but 23 are not limited to management practices related to 24 bioretention, landscaping, the use of permeable or 25 pervious pavement, and soil quality restoration. The 26 moneys shall be allocated on a cost-share basis as 27 provided in chapter 161A. 28 7. Notwithstanding any other provision of law 29 to the contrary, the department may use moneys 30 appropriated in subsection 1 to carry out the 31 provisions of this section on a cost-share basis 32 in combination with other moneys available to the 33 department from a state or federal source. 34 8. Not more than 10 percent of the moneys 35 appropriated in this section may be used to pay 36 for the costs of administering and implementing the 37 water quality initiative by the department’s soil 38 conservation division as provided in section 466B.42 39 and this section. 40 DIVISION X 41 DEPARTMENT OF NATURAL RESOURCES 42 GENERAL APPROPRIATIONS FOR FY 2016-2017 43 Sec. 33. GENERAL FUND —— DEPARTMENT. 44 1. The report shall describe in detail 20 the expenditure of moneys appropriated under this 21 section to support the department’s administration, 22 regulation, and programs. 23 Sec. 34. STATE FISH AND GAME PROTECTION FUND —— 24 REGULATION AND ADVANCEMENT OF OUTDOOR ACTIVITIES. 25 1. Not more than 15 percent of the moneys 24 appropriated in paragraph “a” may be used for costs of 25 administration and implementation of soil and water 26 conservation practices. 27 h. In lieu of moneys appropriated in section 28 466A.5 , not more than $25,000 of the moneys 29 appropriated in paragraph “a” shall be used by the soil 30 conservation division of the department of agriculture 31 and land stewardship to provide administrative support 32 to the watershed improvement review board established 33 in section 466A.3 . 34 7. Notwithstanding section 8.33, moneys 24 appropriated for the fiscal year beginning July 1, 25 2016, in this division of this Act to the department of 26 agriculture and land stewardship to provide financial 27 assistance for the establishment of permanent soil and 28 water conservation practices that remain unencumbered 29 or unobligated at the close of the fiscal year shall 30 not revert but shall remain available for expenditure 31 for the purposes designated until the close of the 32 fiscal year beginning July 1, 2019. 33 DIVISION XIII 34 PERSONNEL SETTLEMENT AGREEMENT PAYMENTS 35 Sec. 44. PERSONNEL SETTLEMENT AGREEMENT 36 PAYMENTS. As a condition made to any appropriation to 37 the department of agriculture and land stewardship, 38 the department of natural resources, or Iowa state 39 university of science and technology for the fiscal 40 year beginning July 1, 2016, and ending June 30, 2017, 41 as provided in this Act, the moneys appropriated and 42 any other moneys available for use by that entity for 43 that fiscal year under this Act shall not be used 44 for the payment of a personnel settlement agreement 45 between that entity and a state employee that contains 46 a confidentiality provision intended to prevent 47 public disclosure of the agreement or any terms of the 48 agreement. 49 DIVISION XIV 50 -29- SF494.1870.H (2) 86 md 29/ 30
RELATED STATUTORY CHANGES FOR CODIFICATION IN 2015 1 BLUFFLANDS PROTECTION PROGRAM AND REVOLVING FUND 2 Sec. 45. Section 161A.80, subsection 2, paragraphs 3 a and b, Code 2015, are amended by striking the 4 paragraphs. 5 Sec. 46.
