PERSONNEL SETTLEMENT AGREEMENT 23 PAYMENTS. As a condition of the appropriations in 24 this Act, the moneys appropriated and any other moneys 25 available shall not be used for payment of a personnel 26 settlement agreement that contains a confidentiality 27 provision intended to prevent public disclosure of the 28 agreement or any terms of the agreement. 29 Sec. 29. Section 8.57, subsection 5, paragraph h, 16 Code 2015, is amended by striking the paragraph. 17 Sec. 33. 2012 Iowa Acts, chapter 1138, section 7, 18 subsection 2, is amended to read as follows: 19 2. A banking division mortgage servicing settlement 20 fund is established, separate and apart from all 21 other public moneys or funds of the state, under the 22 control of the division of banking of the department of 23 commerce. The banking division shall deposit moneys 24 received by the division from the joint state-federal 25 mortgage servicing settlement into the fund. Moneys 26 deposited in the fund are appropriated to the banking 27 division to be used as provided in a financial 28 plan developed by the superintendent of banking and 29 approved by the department of management to support 30 state financial regulation, including oversight of 31 mortgage lending and mortgage servicing, real estate 32 and real estate appraisal, state chartered banks, and 33 other financial services regulated by the division 34 of banking. Moneys in the fund may also be used to 35 support financial literacy efforts. The financial 36 plan may be updated periodically as provided by the 37 superintendent and approved by the department of 38 management. Notwithstanding section 8.33 , moneys in 39 the fund that remain unencumbered or unobligated at 40 the close of a fiscal year shall not revert but shall 41 remain available for expenditure for the purposes 42 designated until the close of the fiscal year that 43 begins July 1, 2014. PERSONNEL SETTLEMENT AGREEMENT 35 PAYMENTS.
