REPORT.

1.
The
department
of
inspections
and
appeals,
in

conjunction
with
the
department
of
human
services,

shall
establish
and
facilitate
a
committee
of

stakeholders
to
examine
options
for
designating
a
12
facility
to
provide
care
for
elderly
persons
in
this
13
state
who
are
sexually
aggressive,
combative,
or
have
14
unmet
geropsychiatric
needs.

2.
The
membership
of
the
committee
shall
include
16
but
is
not
limited
to
the
following:

a.
Representatives
of
the
departments
of
18
inspections
and
appeals,
human
services,
corrections,
19
public
health,
and
aging,
the
state
public
defender,
20
the
office
of
ombudsman,
the
office
of
long-term
care
21
ombudsman,
and
the
judicial
branch.

b.
Consumers
of
services
provided
by
long-term
care
23
facilities
and
family
members
of
consumers.

c.
Representatives
from
leadingage
Iowa,
the
Iowa
25
health
care
association,
and
the
Iowa
association
of
26
community
providers.

d.
Direct
care
workers
employed
by
long-term
care

facilities.

Representatives
from
Iowa
legal

The
committee
shall
discuss
whether
a
long-term

care
facility,
as
defined
in
section
142D.2,
should

have
the
ability
to
refuse
admission
to,
or
discharge,

residents
who
are
sexually
aggressive,
combative,
or

have
unmet
geropsychiatric
needs.
The
committee
shall
6
consider
options
for
establishment
of
a
facility
to
7
provide
care
for
persons
who
are
sexually
aggressive,
8
combative,
or
have
unmet
geropsychiatric
needs.
The
9
committee
shall
identify
the
characteristics
of
10
residents
for
such
a
facility,
options
for
creating
11
a
new
facility
to
house
such
residents,
options
for
12
the
expansion
of
an
existing
facility
to
house
such
13
residents,
options
for
using
any
alternative
facilities
14
for
such
residents,
the
workforce
and
training
15
necessary
for
the
workforce
in
such
facility,
options
16
to
qualify
a
facility
for
Medicaid
reimbursement,
17
cost
projections
for
any
recommendations,
and
other
18
information
deemed
relevant
by
the
department
of
19
inspections
and
appeals.

4.
The
committee
shall
provide
a
report
detailing
21
its
findings
and
recommendations
to
the
governor
and
22
the
general
assembly
by
December
15,
2016.
