distribute

grant

received

applicants
in
the
following
order

priority:

(a)
Public
entities
that
provide
family
planning

services
including
state,
county,
or
local
community

health
clinics
and
federally
qualified
health
centers.

(b)
Nonpublic
entities
that,
in
addition
to
family
13
planning
services,
provide
required
primary
health
14
services
as
described
in
42
U.S.C.
§254b(b)(1)(A).
15
(c)
Nonpublic
entities
that
provide
family
planning
16
services
but
do
not
provide
required
primary
health
17
services
as
described
in
42
U.S.C.
§254b(b)(1)(A).

(2)
Distribution
of
funds
under
this
paragraph
19
shall
be
made
in
a
manner
that
continues
access
to
20
family
planning
services.
21
(3)
Distribution
of
funds
shall
not
be
made
to
any
22
entity
that
performs
abortions
or
that
maintains
or
23
operates
a
facility
where
abortions
are
performed.
For
24
the
purposes
of
this
paragraph,
“abortion”
does
not
25
include
any
of
the
following:
26
(a)
The
treatment
of
a
woman
for
a
physical
27
disorder,
physical
injury,
or
physical
illness,
28
including
a
life-endangering
physical
condition
caused
29
by
or
arising
from
the
pregnancy
itself,
that
would,
30
as
certified
by
a
physician,
place
the
woman
in
danger
31
of
death.

(b)
The
treatment
of
a
woman
for
a
spontaneous
33
abortion,
commonly
known
as
a
miscarriage,
when
not
all
34
of
the
products
of
human
conception
are
expelled.

Funds
distributed
in
accordance
with
this

paragraph
shall
not
be
used
for
direct
or
indirect
2
costs,
including
but
not
limited
to
administrative
3
costs
or
expenses,
overhead,
employee
salaries,
rent,
4
and
telephone
and
other
utility
costs,
related
to
5
providing
abortions
as
specified
in
this
paragraph.
6
(5)
The
department
of
human
services
shall
7
submit
a
report
to
the
governor
and
the
general
8
assembly,
annually
by
January
1,
listing
any
entities
9
that
received
funds
pursuant
to
subparagraph
(1),
10
subparagraph
division
(c),
and
the
amount
and
type
of
11
funds
received
by
such
entities
during
the
preceding
12
calendar
year.
The
report
shall
provide
a
detailed
13
explanation
of
how
the
department
determined
that
14
distribution
of
funds
to
such
an
entity,
instead
of
to
15
an
entity
described
in
subparagraph
(1),
subparagraph
16
division
(a)
or
(b),
was
necessary
to
prevent
severe
17
limitation
or
elimination
of
access
to
family
planning
18
services
in
the
region
of
the
state
where
the
entity
19
is
located.

Any
contract
entered
into
on
or
after
July
21
1,
2016,
by
the
department
of
public
health
to
22
administer
the
personal
responsibility
education
23
program
as
specified
in
42
U.S.C.
§713
or
to
administer
24
the
abstinence
education
grant
program
authorized
25
pursuant
to
section
510
of
Tit.
V
of
the
federal
Social
26
Security
Act,
shall
exclude
as
an
eligible
applicant
27
any
applicant
entity
that
provides
abortions
or
that
28
maintains
or
operates
a
facility
where
abortions
are
29
performed.
