NEW SECTION . 135.190 Possession and 4 administration of opioid antagonists. 5 1. For purposes of this section, unless the context 6 otherwise requires: 7 a. “Opioid antagonist” means the same as defined in 8 section 147A.1. 9 b. “Opioid-related overdose” means the same as 10 defined in section 147A.1. 11 c. “Person in a position to assist” means a family 12 member, friend, caregiver, health care provider, 13 employee of a substance abuse treatment facility, or 14 other person who may be in a place to render aid to 15 a person at risk of experiencing an opioid-related 16 overdose. 17 2. A person in a position to assist may possess 18 and provide or administer an opioid antagonist to 19 an individual if the person in a position to assist 20 reasonably and in good faith believes that such 21 individual is experiencing an opioid-related overdose. 22 3. A person in a position to assist who has acted 23 reasonably and in good faith shall not be liable for 24 any injury arising from the provision, administration, 25 or assistance in the administration of an opioid 26 antagonist as provided in this section. 27 Sec. 2. Section 147A.1, Code 2016, is amended by 28 adding the following new subsections: 29 NEW SUBSECTION . 6A. “First responder” means an 30 emergency medical care provider, a registered nurse 31 staffing an authorized service program under section 32 147A.12, a physician assistant staffing an authorized 33 service program under section 147A.13, a fire fighter, 34 or a peace officer as defined in section 801.4 who 35 -1- HF2380.3171 (1) 86 (amending this HF 2380 to CONFORM TO SF 2218) jh/nh 1/ 4 #1.
is trained and authorized to administer an opioid 1 antagonist. 2 NEW SUBSECTION . 6B. “Licensed health care 3 professional” means the same as defined in section 4 280.16. 5 NEW SUBSECTION . 6C. “Opioid antagonist” means 6 a drug that binds to opioid receptors and blocks 7 or inhibits the effects of opioids acting on those 8 receptors, including but not limited to naloxone 9 hydrochloride or any other similarly acting 10 drug approved by the United States food and drug 11 administration. 12 NEW SUBSECTION . 6D. “Opioid-related overdose” 13 means a condition affecting a person which may 14 include extreme physical illness, a decreased level 15 of consciousness, respiratory depression, a coma, or 16 the ceasing of respiratory or circulatory function 17 resulting from the consumption or use of an opioid, or 18 another substance with which an opioid was combined. 19 Sec. 3. NEW SECTION . 147A.18 Possession and 20 administration of an opioid antagonist —— immunity. 21 1. Notwithstanding any other provision of law to 22 the contrary, a licensed health care professional may 23 prescribe an opioid antagonist in the name of a service 24 program, law enforcement agency, or fire department to 25 be maintained for use as provided in this section. 26 2. A service program, law enforcement agency, 27 or fire department may obtain a prescription for and 28 maintain a supply of opioid antagonists. A service 29 program, law enforcement agency, or fire department 30 that obtains such a prescription shall replace an 31 opioid antagonist upon its use or expiration. 32 3. A first responder employed by a service program, 33 law enforcement agency, or fire department that 34 maintains a supply of opioid antagonists pursuant to 35 -2- HF2380.3171 (1) 86 (amending this HF 2380 to CONFORM TO SF 2218) jh/nh 2/ 4
this section may possess and provide or administer such 1 an opioid antagonist to an individual if the first 2 responder reasonably and in good faith believes that 3 such individual is experiencing an opioid-related 4 overdose. 5 4. The following persons, provided they have acted 6 reasonably and in good faith, shall not be liable for 7 any injury arising from the provision, administration, 8 or assistance in the administration of an opioid 9 antagonist as provided in this section: 10 a. A first responder who provides, administers, or 11 assists in the administration of an opioid antagonist 12 to an individual as provided in this section. 13 b. A service program, law enforcement agency, or 14 fire department. 15 c. The prescriber of the opioid antagonist. 16 5. The department shall adopt rules pursuant 17 to chapter 17A to implement and administer this 18 section, including but not limited to standards 19 and procedures for the prescription, distribution, 20 storage, replacement, and administration of opioid 21 antagonists, and for the training and authorization 22 to be required for first responders to administer an 23 opioid antagonist. 24 Sec. 4. CONTINGENT IMPLEMENTATION. Implementation 25 of the section of this Act enacting section 147A.18 is 26 contingent upon the availability of funding. > 27 2.
