Section 139A.8, subsection 4, Code 2016, 4 is amended to read as follows: 5 4. a. Immunization is not required for a person’s 6 enrollment in any elementary or secondary school or 7 licensed child care center if either of the following 8 applies: 9 (1) The applicant, or if the applicant is a minor, 10 the applicant’s parent or legal guardian, submits 11 to the admitting official a statement signed by a 12 physician, advanced registered nurse practitioner, 13 or physician assistant who is licensed by the board 14 of medicine, board of nursing, or board of physician 15 assistants that the immunizations required would be 16 injurious to the health and well-being of the applicant 17 or any member of the applicant’s family. 18 (2) The applicant, or if the applicant is a minor, 19 the applicant’s parent or legal guardian, submits an 20 affidavit signed by the applicant, or if the applicant 21 is a minor, the applicant’s parent or legal guardian, 22 stating that the immunization conflicts with the tenets 23 and practices of a recognized religious denomination of 24 which the applicant is an adherent or member. 25 b. In addition to the exemptions provided in 26 paragraph “a” , if the immunization is against 27 meningococcal disease as required pursuant to 28 subsection 2, paragraph “e” , the immunization is not 29 required for a person’s enrollment in any elementary 30 or secondary school or licensed child care center 31 if the applicant, or if the applicant is a minor, 32 the applicant’s parent or legal guardian, submits an 33 affidavit signed by the applicant, or if the applicant 34 is a minor, the applicant’s parent or legal guardian, 35 -1- SF2136.3126 (2) 86 pf/nh 1/ 2 #1.

stating that the applicant opposes the immunization on 1 the basis of personal conviction. 2 b. c. The exemptions under this subsection do not 3 apply in times of emergency or epidemic as determined 4 by the state board of health and as declared by the 5 director of public health. > 6 2.
