1.
For
the
purposes
of
this
section:

a.
“Abortion”
means
as
defined
in
section
146.1.
10
b.
“Human
fetal
tissue”
means
tissue
or
cells

obtained
from
a
dead
human
embryo
or
fetus
after
a
12
spontaneous
termination
of
pregnancy,
an
abortion,
or
a
13
stillbirth.

c.
“Spontaneous
termination
of
pregnancy”
means
as
15
defined
in
section
144.29A.
16
d.
“Stillbirth”
means
as
defined
in
section
136A.2.
17
e.
“Valuable
consideration”
does
not
include
18
reasonable
payments
associated
with
the
transportation,
19
implantation,
processing,
preservation,
quality
20
control,
or
storage
of
human
fetal
tissue.

2.
A
person
shall
not
knowingly
acquire,
receive,
22
or
otherwise
transfer
any
human
fetal
tissue
for
23
valuable
consideration
in
this
state.
24
3.
This
section
shall
not
be
interpreted
to
25
prohibit
the
use
of
human
fetal
tissue
for
therapeutic
26
purposes
or
research
otherwise
authorized
by
state
or
27
federal
law.

4.
A
person
who
violates
this
section
is
guilty
of
29
a
class
“C”
felony,
punishable
by
imprisonment
for
no
30
more
than
ten
years
and
a
fine
of
not
less
than
twice
31
the
amount
of
the
valuable
consideration
received.
32
Sec.
2.
EFFECTIVE
UPON
ENACTMENT.
This
Act,
being
33
deemed
of
immediate
importance,
takes
effect
upon
34
enactment.
