NEW SECTION . 135.190 Opioid 3 antagonists —— possession and administration by 4 immediate family members. 5 1. For purposes of this section, unless the context 6 otherwise requires: 7 a. “Immediate family member” means a spouse; 8 natural or adoptive parent, child, or sibling; 9 stepparent, stepchild, or stepsibling; father-in-law, 10 mother-in-law, son-in-law, daughter-in-law, 11 brother-in-law, or sister-in-law; or grandparent or 12 grandchild. 13 b. “Licensed health care professional” means the 14 same as defined in section 280.16. 15 c. “Opioid antagonist” means the same as defined in 16 section 147A.1. 17 d. “Opioid-related overdose means the same as 18 defined in section 147A.1. 19 2. Notwithstanding any other provision of law to 20 the contrary, a licensed health care professional may 21 prescribe an opioid antagonist to the immediate family 22 member of a person who is at risk of experiencing an 23 opioid-related overdose. 24 3. An immediate family member of a person who is 25 at risk of experiencing an opioid-related overdose may 26 possess and provide or administer an opioid antagonist 27 to the person who is at risk of experiencing an 28 opioid-related overdose if the immediate family member 29 reasonably and in good faith believes that the person 30 is experiencing an opioid-related overdose. 31 4. A prescriber of an opioid antagonist, who has 32 acted reasonably and in good faith, shall not be 33 liable for any injury arising from the provision, 34 administration, or assistance in the administration of 35 -1- HF2380.2842 (1) 86 jh/nh 1/ 2 #1.
