The application shall include a cost 15 benefit analysis performed by the applicable political 16 subdivision, plans and a timeline for closing of the 17 facility, and plans for the future use of the facility. 18 The process adopted by the department shall provide 19 that if the future use of the facility results in a 20 project that creates jobs and expands the economy, the 21 department shall forgive any required repayment of 22 financial assistance that may be owed to the state as 23 a result of the closure of the airport provided that 24 the amount of private investment in the project for the 25 future use of the facility is equal to at least two 26 times the amount estimated to be repaid to the state. 27 e. (1) For deposit in the water quality initiative 6 fund created in section 466B.45 for purposes of 7 supporting the water quality initiative administered by 8 the soil conservation division as provided in section 9 466B.42, including salaries, support, maintenance, and 10 miscellaneous purposes: 11 FY 2015-2016: 12 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 3,100,000 13 (2) (a) The moneys appropriated in this lettered 14 paragraph shall be used to support projects in 15 subwatersheds as designated by the department that 16 are part of high-priority watersheds identified by 17 the water resources coordinating council established 18 pursuant to section 466B.3. 19 (b) The moneys appropriated in this lettered 20 paragraph shall be used to support projects in 21 watersheds generally, including regional watersheds, as 22 designated by the division and high-priority watersheds 23 identified by the water resources coordinating council 24 established pursuant to section 466B.3. 25 (3) In supporting projects in subwatersheds and 26 watersheds as provided in subparagraph (2), all of the 27 following shall apply: 28 (a) The demonstration projects shall utilize water 29 quality practices as described in the latest revision 30 of the document entitled “Iowa Nutrient Reduction 31 Strategy” initially presented in November 2012 by 32 the department of agriculture and land stewardship, 33 the department of natural resources, and Iowa state 34 university of science and technology. 35 (b) The division shall implement demonstration 36 projects as provided in subparagraph division (a) by 37 providing for participation by persons who hold a legal 38 interest in agricultural land used in farming. To 39 every extent practical, the division shall provide for 40 collaborative participation by such persons who hold a 41 legal interest in agricultural land located within the 42 same subwatershed. 43 (c) The division shall implement a demonstration 44 project on a cost-share basis as determined by the 45 division. However, the state’s share of the amount 46 shall not exceed 50 percent of the estimated cost of 47 establishing the practice as determined by the division 48 or 50 percent of the actual cost of establishing the 49 practice, whichever is less. 50 -9- HF650.1934.S (1) 86 9/ 16
(d) The demonstration projects shall be used to 1 educate other persons about the feasibility and value 2 of establishing similar water quality practices. The 3 division shall promote field day events for purposes of 4 allowing interested persons to establish water quality 5 practices on their agricultural land. 6 (e) The division shall conduct water quality 7 evaluations within supported subwatersheds. Within 8 a reasonable period after accumulating information 9 from such evaluations, the division shall create an 10 aggregated database of water quality practices. Any 11 information identifying a person holding a legal 12 interest in agricultural land or specific agricultural 13 land shall be a confidential record under section 22.7 . 14 (4) The moneys appropriated in this lettered 15 paragraph shall be used to support education and 16 outreach in a manner that encourages persons who 17 hold a legal interest in agricultural land used for 18 farming to implement water quality practices, including 19 the establishment of such practices in watersheds 20 generally, and not limited to subwatersheds or 21 high-priority watersheds. 22 (5) The moneys appropriated in this lettered 23 paragraph may be used to contract with persons to 24 coordinate the implementation of efforts provided in 25 this paragraph. 26 (6) The moneys appropriated in this lettered 27 paragraph may be used by the department to support 28 urban soil and water conservation efforts, which may 29 include but are not limited to management practices 30 related to bioretention, landscaping, the use of 31 permeable or pervious pavement, and soil quality 32 restoration. Notwithstanding section 8.33 , moneys 29 appropriated to the department of economic development 30 in section 18 , subsection 4, paragraph “a”, of 31 this division of this Act as amended by 2009 Iowa 32 Acts, chapter 173, section 24, and 2011 Iowa Acts, 33 chapter 133, section 34, that remain unencumbered or 34 unobligated at the close of the fiscal year for which 35 the appropriation was made shall not revert but shall 36 remain available for the purpose designated until the 37 close of the fiscal year that begins July 1, 2014, or 38 until the project for which the appropriation was made 39 is completed, whichever is earlier. 40 5. Section 8.57C, subsection 3, paragraph a, 23 Code 2015, is amended to read as follows: 24 a.
