PERSONNEL SETTLEMENT AGREEMENT 40 PAYMENTS. As a condition of the appropriations in 41 this Act, the moneys appropriated and any other moneys 42 available shall not be used for payment of a personnel 43 settlement agreement that contains a confidentiality 44 provision intended to prevent public disclosure of the 45 agreement or any terms of the agreement. 46 Sec. 30. Section 8.57, subsection 5, paragraph h, 33 Code 2015, is amended by striking the paragraph. 34 Sec. 34. 2012 Iowa Acts, chapter 1138, section 7, 35 subsection 2, is amended to read as follows: 36 2. A banking division mortgage servicing settlement 37 fund is established, separate and apart from all 38 other public moneys or funds of the state, under the 39 control of the division of banking of the department of 40 commerce. The banking division shall deposit moneys 41 received by the division from the joint state-federal 42 mortgage servicing settlement into the fund. Moneys 43 deposited in the fund are appropriated to the banking 44 division to be used as provided in a financial 45 plan developed by the superintendent of banking and 46 approved by the department of management to support 47 state financial regulation, including oversight of 48 mortgage lending and mortgage servicing, real estate 49 and real estate appraisal, state chartered banks, and 50 -13- HF659.1887.S (2) 86 jh 13/ 26
other financial services regulated by the division 1 of banking. Moneys in the fund may also be used to 2 support financial literacy efforts. The financial 3 plan may be updated periodically as provided by the 4 superintendent and approved by the department of 5 management. Notwithstanding section 8.33 , moneys in 6 the fund that remain unencumbered or unobligated at 7 the close of a fiscal year shall not revert but shall 8 remain available for expenditure for the purposes 9 designated until the close of the fiscal year that 10 begins July 1, 2014. Any unencumbered or unobligated 11 moneys remaining in the fund on June 30, 2015, shall be 12 are transferred to the general fund of the state office 13 of the secretary of state for deposit in the address 14 confidentiality program revolving fund established in 15 2015 Iowa Acts, House File 585, if enacted, and are 16 appropriated to the office of the secretary of state 17 to be used for the start-up costs of implementing the 18 address confidentiality program established in 2015 19 Iowa Acts, House File 585, if enacted . 20 Sec. 35. Section 9.8, subsection 1, if enacted by 21 2015 Iowa Acts, House File 585, section 1, is amended 22 to read as follows: 23 1. An address confidentiality program revolving 24 fund is created in the state treasury. The fund 25 shall consist of moneys collected by the clerk of the 26 district court and transferred to the office of the 27 secretary of state for deposit in the fund pursuant 28 to section 602.8108, subsection 6A , and transfers of 29 interest, earnings, and moneys from other funds as 30 provided by law . The moneys in the fund are subject 31 to appropriation to the office of the secretary of 32 state by the general assembly. The office of the 33 secretary of state shall administer the fund. The 34 office of the secretary of state shall provide an 35 annual report to the department of management and 36 the legislative services agency on expenditures from 37 the fund in a format as determined by the department 38 of management in consultation with the legislative 39 services agency. 40 Sec. 36. Section 9.8, subsection 3, if enacted by 41 2015 Iowa Acts, House File 585, section 1, is amended 42 to read as follows: 43 3. Section 8.33 does not apply to any moneys 44 transferred, credited, or appropriated to the revolving 45 fund. 46 Sec. 37. REPEAL. Sections 8.41A and 8.57B, Code 47 2015, are repealed. 48 Sec. 38. Before the 15 division expends or encumbers an amount in excess of 16 the moneys budgeted for regulation, the division shall 17 first do both of the following: 18 (a) Notify the department of management, the 19 legislative services agency, and the legislative fiscal 20 committee of the need for the expenditures. 21 (b) File with each of the entities named in 22 subparagraph division (a) the legislative and 23 regulatory justification for the expenditures, along 24 with an estimate of the expenditures. 25 3. PERSONNEL SETTLEMENT AGREEMENT 29 PAYMENTS.
