Contingent upon the enactment 29 of 2015 Iowa Acts, House File 585, establishing 30 an address confidentiality program for certain 31 victims of crimes, any unencumbered or unobligated 32 moneys remaining in the vertical infrastructure fund 33 established in section 8.57B on June 30, 2015, shall 34 be transferred to the office of the secretary of state 35 for deposit in the address confidentiality program 36 fund established in 2015 Iowa Acts, House File 585, 37 if enacted, to be used for the start-up costs of 38 implementing the address confidentiality program. 39 Sec. ___. Section 8.57, subsection 5, paragraph h, 40 Code 2015, is amended by striking the paragraph. 41 Sec. ___. 2012 Iowa Acts, chapter 1138, section 7, 42 subsection 2, is amended to read as follows: 43 2. A banking division mortgage servicing settlement 44 fund is established, separate and apart from all 45 other public moneys or funds of the state, under the 46 control of the division of banking of the department of 47 commerce. deposited in the fund are appropriated to the banking 1 division to be used as provided in a financial 2 plan developed by the superintendent of banking and 3 approved by the department of management to support 4 state financial regulation, including oversight of 5 mortgage lending and mortgage servicing, real estate 6 and real estate appraisal, state chartered banks, and 7 other financial services regulated by the division 8 of banking. Moneys in the fund may also be used to 9 support financial literacy efforts. The financial 10 plan may be updated periodically as provided by the 11 superintendent and approved by the department of 12 management. Notwithstanding section 8.33 , moneys in 13 the fund that remain unencumbered or unobligated at 14 the close of a fiscal year shall not revert but shall 15 remain available for expenditure for the purposes 16 designated until the close of the fiscal year that 17 begins July 1, 2014. Any Contingent upon the enactment 18 of 2015 Iowa Acts, House File 585, establishing an 19 address confidentiality program for certain victims 20 of crimes, any unencumbered or unobligated moneys 21 remaining in the fund on June 30, 2015, shall be 22 transferred to the general fund of the state office 23 of the secretary of state for deposit in the address 24 confidentiality program fund established in 2015 25 Iowa Acts, House File 585, if enacted, to be used 26 for the start-up costs of implementing the address 27 confidentiality program . 28 Sec. ___. REPEAL. Sections 8.41A and 8.57B, Code 29 2015, are repealed. 30 Sec. ___. EFFECTIVE UPON ENACTMENT. The following 31 provisions of this division of this Act, being deemed 32 of immediate importance, take effect upon enactment: 33 1. The section of this Act transferring moneys 34 remaining in the federal recovery and reinvestment 35 fund established in section 8.41A on June 30, 2015, to 36 the office of the secretary of state for deposit in 37 the address confidentiality program fund established 38 in 2015 Iowa Acts, House File 585, if enacted, to 39 be used by the office of the secretary of state 40 for the start-up costs of implementing the address 41 confidentiality program. 42 2.
