By striking page 1, line 33, through page 2, 5 line 5, and inserting: 6 < b. “Harassment” and “bullying” shall be construed 7 to mean any electronic, written, verbal, or physical 8 act or conduct toward a student which is based on any 9 actual or perceived trait or characteristic of the 10 student and which creates an objectively hostile school 11 environment that meets one or more of the following 12 conditions: 13 (1) Places the student in reasonable fear of harm 14 to the student’s person or property Is lewd, indecent, 15 or obscene . 16 (2) Has a substantially detrimental effect on 17 the student’s physical or mental health Is a severe, 18 persistent, or pervasive use of threatening acts 19 or conduct that objectively inflicts injury on the 20 student . 21 (3) Has the effect of substantially interfering 22 with a student’s academic performance Is intended to 23 threaten imminent physical harm to the student . 24 (4) Has the effect of substantially interfering 25 with the student’s ability to participate in or benefit 26 from the services, activities, or privileges provided 27 by a school Is intended to incite an immediate breach 28 of the peace . 29 (5) Causes a substantial and material disruption 30 of the school environment. 31 Sec. ___. Section 280.28, subsection 2, paragraph 32 c, Code 2015, is amended by striking the paragraph. > 33 3.
