Senate File 275 H-1175 Amend Senate File 275, as passed by the Senate, as 1 follows: 2 1. By striking page 1, line 1, through page 8, line 3 6, and inserting: 4 < Section 1. Section 135A.2, subsections 2, 11, 5 14, and 16, Code 2015, are amended by striking the 6 subsections. 7 Sec. ___. Section 135A.2, subsection 8, Code 2015, 8 is amended to read as follows: 9 8. “Designated local public health agency” means 10 an entity that is either governed by or contractually 11 responsible to a local board of health and designated 12 by the local board to comply with the Iowa public 13 health standards for a jurisdiction . 14 Sec. ___. Section 135A.3, Code 2015, is amended to 15 read as follows: 16 135A.3 Governmental public health system 17 modernization —— lead agency. 18 1. The department is designated as the lead agency 19 in this state to administer this chapter . 20 2. The department, in collaboration with the 21 governmental public health advisory council and the 22 governmental public health evaluation committee, shall 23 coordinate implementation of this chapter including 24 but not limited to the voluntary accreditation of 25 designated local public health agencies and the 26 department in accordance with the Iowa public health 27 standards. Such implementation administration shall 28 include evaluation of and quality improvement measures 29 for the governmental public health system. 30 Sec. ___. Section 135A.4, subsection 6, paragraph 31 b, Code 2015, is amended to read as follows: 32 b. Propose to the director public health standards 33 that should may be utilized for voluntary accreditation 34 of designated local public health agencies and the 35 department that include but are not limited to the 36 organizational capacity and by the governmental public 37 health service components described in section 135A.6, 38 subsection 1 , by October 1, 2009 system . 39 Sec. ___. Section 135A.4, subsection 6, paragraphs 40 c, d, and e, Code 2015, are amended by striking the 41 paragraphs. 42 Sec. ___. Section 135A.5, subsection 1, Code 2015, 43 is amended to read as follows: 44 1. A governmental public health evaluation 45 committee is established to develop and implement the 46 evaluation of the governmental public health system 47 and voluntary accreditation program . The committee 48 shall meet at least quarterly. The committee shall 49 consist of no fewer than eleven members and no more 50 -1- SF275.1166 (3) 86 pf/rj 1/ 3 #1.
than thirteen members. The members shall be appointed 1 by the director of the department. The director may 2 solicit and consider recommendations from professional 3 organizations, associations, and academic institutions 4 in making appointments to the committee. 5 Sec. ___. Section 135A.5, subsection 6, paragraphs 6 a and b, Code 2015, are amended to read as follows: 7 a. Develop and implement processes for evaluation 8 of the governmental public health system and the 9 voluntary accreditation program . 10 b. Collect and report baseline information for 11 organizational capacity and public health service 12 delivery based on the Iowa public health standards 13 prior to implementation of the voluntary accreditation 14 program on January 2, 2012 . 15 Sec. ___. Section 135A.5, subsection 6, paragraphs 16 c and d, Code 2015, are amended by striking the 17 paragraphs. 18 Sec. ___. Section 135A.6, subsection 1, unnumbered 19 paragraph 1, Code 2015, is amended to read as follows: 20 The governmental public health system , in accordance 21 with the Iowa public health standards, shall include 22 but not be limited to the following organizational 23 capacity components and public health service 24 components: 25 Sec. ___. Section 135A.8, subsections 2 and 3, Code 26 2015, are amended to read as follows: 27 2. The fund is established to assist local boards 28 of health and the department with the provision of 29 governmental public health system organizational 30 capacity and public health service delivery and 31 to achieve and maintain voluntary accreditation in 32 accordance with the Iowa public health standards . 33 At least seventy percent of the funds shall be made 34 available to local boards of health and up to thirty 35 percent of the funds may be utilized by the department. 36 3. Moneys in the fund may be allocated by 37 the department to a local board of health for 38 organizational capacity and service delivery. Such 39 allocation may be made on a matching, dollar-for-dollar 40 basis for the acquisition of equipment, or by providing 41 grants to achieve and maintain voluntary accreditation 42 in accordance with the Iowa public health standards . 43 Sec. ___. Section 135A.9, Code 2015, is amended to 44 read as follows: 45 135A.9 Rules. 46 The state board of health shall adopt rules pursuant 47 to chapter 17A to implement this chapter which shall 48 include but are not limited to the following: 49 1. standards recommended to the department pursuant to 1 section 135A.4, subsection 6 . 2 2. A voluntary accreditation process to begin no 3 later than January 2, 2012, for designated local public 4 health agencies and the department. 5 3. 1. Rules relating to the operation of the 6 governmental public health advisory council. 7 4. 2. Rules relating to the operation of the 8 governmental public health system evaluation committee. 9 5. 3. The application and award process for 10 governmental public health system fund moneys. 11 6. Rules relating to data collection for the 12 governmental public health system and the voluntary 13 accreditation program. 14 7. 4. Rules otherwise necessary to implement the 15 chapter. > 16 2. Page 9, after line 32 by inserting: 17 < Sec. ___. REPEAL. Sections 135A.7 and 135A.10, 18 Code 2015, are repealed. 19 Sec. ___. RESIDENTIAL SWIMMING POOLS —— PRIVATE 20 SWIMMING LESSONS. Notwithstanding any provision of 21 law to the contrary, the department of public health 22 shall require that a residential swimming pool used 23 for private swimming lessons for up to two hundred 24 seven hours in a calendar month, or the number of 25 hours prescribed by local ordinance applicable to 26 such use of a residential swimming pool, whichever is 27 greater, be regulated as a residential swimming pool 28 used for commercial purposes pursuant to chapter 135I. 29 The department of public health may adopt rules to 30 implement this section. 31 Sec. ___. EFFECTIVE UPON ENACTMENT. The following 32 provision of this Act, being deemed of immediate 33 importance, takes effect upon enactment: 34 1.
