A contract, policy, or plan providing for 11 third-party payment or prepayment of health or medical 12 expenses shall provide coverage benefits for all 13 preabortion and postabortion counseling provided 14 by a licensed mental health professional as defined 15 in section 228.1, including but not limited to the 16 following classes of third-party payment provider 17 contracts, policies, or plans delivered, issued for 18 delivery, continued, or renewed in this state on or 19 after July 1, 2015: 20 a. Individual or group accident and sickness 21 insurance providing coverage on an expense-incurred 22 basis. 23 b. An individual or group hospital or medical 24 service contract issued pursuant to chapter 509, 514, 25 or 514A. 26 c. An individual or group health maintenance 27 organization contract regulated under chapter 514B. 28 d. An individual or group Medicare supplemental 29 policy, unless coverage pursuant to such policy is 30 preempted by federal law. 31 e. A plan established pursuant to chapter 509A for 32 public employees. 33 2. This section shall not apply to accident-only, 34 specified disease, short-term hospital or medical, 35 hospital confinement indemnity, credit, dental, vision, 36 long-term care, basic hospital and medical-surgical 37 expense coverage as defined by the commissioner, 38 disability income insurance coverage, coverage issued 39 as a supplement to liability insurance, workers’ 40 compensation or similar insurance, or automobile 41 medical payment insurance. 42 3. The commissioner of insurance shall adopt rules 43 pursuant to chapter 17A as necessary to administer this 44 section. > 45 3.
