If the woman does not have a third-party 3 provider contract, policy, or plan that provides 4 coverage for obstetric ultrasounds, the physician 5 may submit an application for reimbursement to the 6 department of public health for reimbursement pursuant 7 to section 135.26A. 8 Sec. ___. NEW SECTION . 135.26A Ultrasound 9 reimbursement fund. 10 1. The department shall establish and implement 11 an ultrasound reimbursement program to provide 12 reimbursement to physicians who provide ultrasounds 13 as a prerequisite to the performance of an abortion 14 pursuant to section 146A.1, for which other third-party 15 payment is not available. A physician may submit an 16 application for reimbursement to the department for 17 review. The department shall establish criteria for 18 reimbursement by rule. 19 2. An ultrasound reimbursement fund is established 20 in the state treasury under the authority of the 21 department. The fund shall consist of moneys 22 appropriated to the fund and, notwithstanding section 23 8.33, such moneys shall not revert to the fund from 24 which appropriated at the close of the fiscal year but 25 shall remain in the ultrasound reimbursement fund. 26 Moneys credited to the fund shall be used as specified 27 in this section. 28 Sec. ___. NEW SECTION . 514C.30 Coverage for 29 ultrasounds. 30 1. A contract, policy, or plan providing for 31 third-party payment or prepayment of health or 32 medical expenses shall provide coverage benefits 33 for all obstetric ultrasounds provided pursuant to 34 section 146A.1 including those deemed to be medically 35 unnecessary, including but not limited to the following 36 classes of third-party payment provider contracts, 37 policies, or plans delivered, issued for delivery, 38 continued, or renewed in this state on or after January 39 1, 2015: 40 a. Individual or group accident and sickness 41 insurance providing coverage on an expense-incurred 42 basis. 43 b. An individual or group hospital or medical 44 service contract issued pursuant to chapter 509, 514, 45 or 514A. 46 c. An individual or group health maintenance 47 organization contract regulated under chapter 514B. 48 d. preempted by federal law. 1 e. A plan established pursuant to chapter 509A for 2 public employees. 3 2. This section shall not apply to accident-only, 4 specified disease, short-term hospital or medical, 5 hospital confinement indemnity, credit, dental, vision, 6 long-term care, basic hospital and medical-surgical 7 expense coverage as defined by the commissioner, 8 disability income insurance coverage, coverage issued 9 as a supplement to liability insurance, workers’ 10 compensation or similar insurance, or automobile 11 medical payment insurance. 12 3. The commissioner of insurance shall adopt rules 13 pursuant to chapter 17A as necessary to administer this 14 section. 15 Sec. ___. ULTRASOUND REIMBURSEMENT FUND —— 16 APPROPRIATION.
