A contract, policy, or plan providing for 10 third-party payment or prepayment of health or medical 11 expenses shall provide coverage benefits for all 12 preabortion psychological counseling provided by a 13 licensed psychiatrist or psychologist, including but 14 not limited to the following classes of third-party 15 payment provider contracts, policies, or plans 16 delivered, issued for delivery, continued, or renewed 17 in this state on or after July 1, 2015: 18 a. Individual or group accident and sickness 19 insurance providing coverage on an expense-incurred 20 basis. 21 b. An individual or group hospital or medical 22 service contract issued pursuant to chapter 509, 514, 23 or 514A. 24 c. An individual or group health maintenance 25 organization contract regulated under chapter 514B. 26 d. An individual or group Medicare supplemental 27 policy, unless coverage pursuant to such policy is 28 preempted by federal law. 29 e. A plan established pursuant to chapter 509A for 30 public employees. 31 2. This section shall not apply to accident-only, 32 specified disease, short-term hospital or medical, 33 hospital confinement indemnity, credit, dental, vision, 34 long-term care, basic hospital and medical-surgical 35 expense coverage as defined by the commissioner, 36 disability income insurance coverage, coverage issued 37 as a supplement to liability insurance, workers’ 38 compensation or similar insurance, or automobile 39 medical payment insurance. 40 3. The commissioner of insurance shall adopt rules 41 pursuant to chapter 17A as necessary to administer this 42 section. > 43 3.
