House File 2473 S-5197 Amend the amendment, S-5196, to House File 2473, 1 as amended, passed, and reprinted by the House, as 2 follows: 3 1. Page 5, after line 12 by inserting: 4 < Sec. ___. Section 403.19A, subsection 2, Code 5 2014, is amended to read as follows: 6 2. a. An eligible city may apply for designation 7 as a pilot project city pursuant to this subsection . 8 An eligible city is a city that wholly contains three 9 or more census tracts and is located in a county 10 meeting one of the following requirements: 11 (1) A county that borders Nebraska. 12 (2) A county that borders South Dakota. 13 (3) A county that borders a state other than 14 Nebraska or South Dakota. 15 (4) A county that borders Illinois. 16 b. (1) The department of economic development 17 shall approve four five eligible cities as pilot 18 project cities, one pursuant to paragraph “a” , 19 subparagraph (1), one pursuant to paragraph “a” , 20 subparagraph (2), and two pursuant to paragraph 21 “a” , subparagraph (3) , and one pursuant to paragraph 22 “a” , subparagraph (4) . The city approved pursuant 23 to paragraph “a” , subparagraph (4), shall have a 24 population of at least eighty-five thousand six hundred 25 residents but not more than one hundred ten thousand 26 residents, which city shall be located in a county with 27 a population of at least one hundred twenty thousand 28 residents but not more than one hundred seventy 29 thousand residents, as determined by the 2010 certified 30 federal census. If two eligible cities are approved 31 which are located in the same county and the county 32 has a population of less than forty-five thousand, the 33 two approved eligible cities shall be considered one 34 pilot project city. If more than two cities meeting 35 the requirements of paragraph “a” , subparagraph (3), 36 apply to be designated as a pilot project city, the 37 department of economic development shall determine 38 which two cities hold the most potential to create new 39 jobs or generate the greatest capital within their 40 areas. Applications from eligible cities seeking 41 approval under paragraph “a” , subparagraph (1), (2), or 42 (3), filed on or after October 1, 2006, shall not be 43 considered. Applications from eligible cities seeking 44 approval under paragraph “a” , subparagraph (4), filed 45 on or after January 1, 2015, shall not be considered. 46 (2) If a pilot project city does not enter into a 47 withholding agreement within one year of its approval 48 as a pilot project city, the city shall lose its 49 status as a pilot project city. cities are located in the same county, the loss of 1 status by one pilot project city shall not cause the 2 second pilot project city in the county to lose its 3 status as a pilot project city. Upon such occurrence, 4 the department of economic development shall take 5 applications from other eligible cities to replace that 6 city. Another city shall be designated within six 7 months. 8 (3) On July 1, 2011, the economic development 9 authority shall assume responsibility for the 10 administration of this subsection . > 11 2.
