The moneys shall be used to support a nationally 16 recognized program that began in 1986 and has been 17 replicated in at least 30 other states, but which 18 is not available through any other entity in this 19 state, and that provides assistance to farmers with 20 disabilities in all 99 counties to allow the farmers to 21 remain in their own homes and be gainfully engaged in 22 farming through provision of agricultural worksite and 23 home modification consultations, peer support services, 24 services to families, information and referral, and 25 equipment loan services. 26 b. Notwithstanding section 8.33 , moneys 27 appropriated in this section that remain unencumbered 28 or unobligated at the close of the fiscal year shall 29 not revert but shall remain available for expenditure 30 for the purposes designated until the close of the 31 succeeding fiscal year. 32 Sec. 8. 2013 Iowa Acts, chapter 132, is amended by 33 adding the following new section: 34 NEW SECTION . The moneys appropriated in subsection 1 20 shall be used to support reducing nutrients projects 21 in subwatersheds as designated by the division that 22 are part of high-priority watersheds identified by 23 the water resources coordinating council established 24 pursuant to section 466B.3 . In supporting reducing 25 nutrients 26 b. The moneys appropriated in subsection 1 shall 27 be used to support projects in watersheds generally, 28 including regional watersheds, as designated by the 29 division and high-priority watersheds identified by 30 the water resources coordinating council established 31 pursuant to section 466B.3. 32 2A. In supporting projects in subwatersheds , the 33 division shall establish and administer demonstration 34 projects as follows and watersheds as provided in 35 subsection 2, all of the following shall apply : 36 a. The demonstration projects shall utilize water 37 quality practices as described in the latest revision 38 of the document entitled “Iowa Nutrient Reduction 39 Strategy” initially presented in November 2012 by 40 the department of agriculture and land stewardship, 41 the department of natural resources, and Iowa state 42 university of science and technology. 43 b. The division shall implement demonstration 44 projects as provided in paragraph “a” by providing for 45 participation by persons who hold a legal interest in 46 agricultural land used in farming. To every extent 47 practical, the division shall provide for collaborative 48 participation by such persons who hold a legal 49 interest in agricultural land located within the same 50 -5- HF2458.4009 (2) 85 da/jp 5/ 19
subwatershed. 1 c. The division shall implement a demonstration 2 project on a cost-share basis as determined by the 3 division. However, the state’s share of the amount 4 shall not exceed 50 percent of the estimated cost of 5 establishing the practice as determined by the division 6 or 50 percent of the actual cost of establishing the 7 practice, whichever is less. 8 d. The demonstration projects shall be used to 9 educate other persons about the feasibility and value 10 of establishing similar water quality practices. The 11 division shall promote field day events for purposes of 12 allowing interested persons to establish water quality 13 practices on their agricultural land. 14 e. The division shall conduct water quality 15 evaluations within supported subwatersheds. Within 16 a reasonable period after accumulating information 17 from such evaluations, the division shall create an 18 aggregated database of water quality practices. Any 19 information identifying a person holding a legal 20 interest in agricultural land or specific agricultural 21 land shall be a confidential record under section 22.7 . 22 3. The moneys appropriated in subsection 1 shall 23 be used to support education and outreach in a manner 24 that encourages persons who hold a legal interest in 25 agricultural land used for farming to implement water 26 quality practices, including the establishment of such 27 practices in watersheds generally, and not limited to 28 subwatersheds or high-priority watersheds. 29 4. The moneys appropriated in subsection 1 may 30 be used to contract with persons to coordinate the 31 implementation of efforts provided in this section. 32 Not more than $150,000 shall be used to support 33 the administration of this section by a full-time 34 equivalent position. 35 5. Notwithstanding any other provision of law 36 to the contrary, the department may use moneys 37 appropriated in subsection 1 to carry out the 38 provisions of this section on a cost-share basis in 39 combination with other moneys appropriated available to 40 the department from the environment first fund created 41 in section 8.57A for cost sharing to match the United 42 States department of agriculture, natural resources 43 conservation service, wetland reserve enhancement 44 program a state or federal source . 45 Sec. 10. 2013 Iowa Acts, chapter 132, section 35, 46 is amended to read as follows: 47 SEC. 35. PERSONNEL SETTLEMENT AGREEMENT 28 PAYMENTS. As a condition made to any appropriation to 29 the department of agriculture and land stewardship, 30 the department of natural resources, or Iowa state 31 university as provided in this Act, moneys appropriated 32 and any other moneys available for use by the entity 33 receiving the appropriation under this Act shall not 34 be used for the payment of a personnel settlement 35 agreement between that entity and a state employee 36 that contains a confidentiality provision intended to 37 prevent public disclosure of the agreement or any terms 38 of the agreement. 39 DIVISION IX 40 DNR —— AIR QUALITY PROGRAM TASK FORCE 41 Sec. 26. AIR QUALITY PROGRAM TASK FORCE. 42 1. As used in this section: 43 a. “Bureau” means the air quality bureau of the 44 department of natural resources. 45 b. “Commission” means the environmental protection 46 commission. 47 c. “Department” means the department of natural 48 resources. 49 d. “Director” means the director of the department. 50 -16- HF2458.4009 (2) 85 da/jp 16/ 19
2. An air quality program task force is created 1 within the department. 2 3. The membership of the task force shall include 3 voting members appointed as follows: 4 a. Nine individuals representing interested 5 organizations as appointed by the governing body of 6 each organization. The interested organizations shall 7 include all of the following: 8 (1) The Iowa utility association. 9 (2) The Iowa association of municipal utilities. 10 (3) The Iowa limestone producers association. 11 (4) The asphalt paving association of Iowa. 12 (5) The Iowa environmental council. 13 (6) The Iowa association of electric cooperatives. 14 (7) The Iowa chapter of the national federation of 15 independent business. 16 (8) The Iowa institute for cooperatives. 17 (9) The agribusiness association of Iowa. 18 b. At least two individuals each representing a 19 private facility as determined by the department. The 20 director shall appoint the individuals. The private 21 facilities shall include all of the following: 22 (1) One that currently pays fees under Title V of 23 the federal Clean Air Act Amendments of 1990, 42 U.S.C. 24 §7401 et seq., pursuant to chapter 455B, including 567 25 IAC ch. 22. 26 (2) One that has been issued a construction permit 27 pursuant to chapter 455B for minor emissions of air 28 contaminants, if the facility is not required to pay 29 fees as provided in subparagraph (1). 30 c. Any other individuals representing persons 31 specified by the department who shall be appointed by 32 the director, including but not limited to additional 33 individuals representing different private facilities 34 as provided in paragraph “b”. The director shall make 35 every effort possible to provide for gender balanced 36 appointments. 37 4. The membership of the task force shall include 38 three nonvoting members appointed as follows: 39 a. One individual representing the department who 40 shall be appointed by the director. 41 b. One individual representing the commission who 42 shall be appointed by the commission. 43 c. One member representing the Iowa association of 44 business and industry who shall be appointed by the 45 governing body of that association. 46 5. a. The department shall provide office space, 47 staff assistance, and necessary supplies and equipment 48 to the task force. 49 b. To every extent feasible, the department shall 50 -17- HF2458.4009 (2) 85 da/jp 17/ 19
nominate and the task force shall vote to approve a 1 qualified person to facilitate the conduct of the 2 meetings in a neutral manner that promotes considered 3 and effective deliberation and consensus. The person 4 shall serve without receiving compensation or expenses. 5 c. A vacancy in the membership of the task force 6 does not impair the right of a quorum to exercise all 7 rights and perform all duties of the task force. 8 d. A majority of voting members of the task force 9 constitutes a quorum. Any action taken by the task 10 force must be adopted by the affirmative vote of a 11 majority of its members present, except that a lesser 12 number may adjourn a meeting. 13 6. a. The task force shall do all of the 14 following: 15 (1) Examine the current status of air quality 16 programs, including associated permits and fees 17 or other funding mechanisms, administered by the 18 department’s air quality bureau. 19 (2) Review resources available to the bureau 20 including but not limited to its full-time and 21 part-time employees and permit processing times with 22 the goal of identifying efficiencies that can be 23 made internally by the bureau to better streamline 24 the permit process for the bureau, permittees, and 25 taxpayers. 26 (3) Consider the future economic impact to 27 consumers, businesses, and taxpayers resulting in all 28 of the following: 29 (a) Maintaining the current fee structure. 30 (b) Establishing, implementing, and administering 31 a new fee structure. 32 (4) Consider the possible need for the 33 establishment of alternative funding mechanisms to 34 support the bureau including a new fee structure and 35 revenue formula to be administered by the bureau. 36 b. The task force may review similar air quality 37 programs and fee structures administered in other 38 states which may be used to identify a national, 39 regional, or other identifiable average of costs for 40 administering such programs. 41 7. a. The task force shall approve a report 42 prepared by the department of natural resources. 43 b. The report shall include findings and 44 recommendations adopted by the task force. 45 c. The department shall submit the report to the 46 governor, the director, the environmental protection 47 commission, and the general assembly not later than 48 December 15, 2014. 49 8. A nonprofit organization that conducts nutrient 18 management research, including but not limited to 19 conducting evaluations, assessments, or validations. 20 2. The information identifies any of the following: 21 a. A person who holds a legal interest in 22 agricultural land or who has previously held a legal 23 interest in agricultural land. 24 b. A person who is involved or who has previously 25 been involved in managing the agricultural land or 26 producing crops or livestock on the agricultural land. 27 c. The identifiable location of the agricultural 28 land. 29 Sec. 30. EFFECTIVE UPON ENACTMENT. This division 30 of this Act, being deemed of immediate importance, 31 takes effect upon enactment. 32 DIVISION XI 33 REPEAL 34 Sec. 31.
