Preschool

scholarship
program.

1.
a.
For
the
purposes
of
this
section,
unless
6
the
context
otherwise
requires,
“scholarship
preschool
7
provider”
means
a
public
or
private
provider
of
8
preschool
services
in
this
state
that
is
not
providing
9
the
preschool
services
under
an
approved
local
program
10
and
has
the
capacity
to
provide
all
of
the
following
to
11
children
receiving
a
preschool
scholarship:
12
(1)
Instruction
from
a
teacher
who
is
appropriately
13
licensed
under
chapter
272
and
meets
requirements
under
14
chapter
284.
The
teacher
shall
possess
a
bachelor’s
15
or
graduate
degree
from
an
accredited
college
or
16
university
with
a
major
in
early
childhood
education
17
or
other
appropriate
major
identified
in
rule
by
the
18
department.
19
(2)
A
set
of
services
operating
in
compliance
20
with
rules
adopted
by
the
state
board
for
scholarship
21
preschool
providers
relating
to
all
of
the
following
22
requirements:
23
(a)
Maximum
and
minimum
teacher-to-child
ratios
and
24
class
sizes.
25
(b)
Applicable
state
and
federal
program
standards.
26
(c)
Student
learning
standards.
27
(d)
A
minimum
of
ten
hours
per
week
of
instruction
28
delivered
on
the
skills
and
knowledge
included
in
the
29
student
learning
standards
developed
for
scholarship
30
preschool
providers.
31
(e)
Parental
involvement
in
the
scholarship
32
preschool
program.
33
(f)
Compliance
with
data
collection
and
performance
34
measurement
processes
and
reporting
as
defined
by
the
35
department
by
rule.

b.
Children
eligible
to
enroll
in
an
approved
37
local
program
implemented
by
a
school
district
in
38
accordance
with
this
chapter
but
who
choose
to
utilize
39
a
scholarship
preschool
provider
for
preschool
shall
40
be
eligible
to
receive
a
preschool
scholarship
in
41
the
manner
provided
in
this
section
for
school
years
42
beginning
on
or
after
July
1,
2014.

2.
By
July
31
of
the
school
year
for
which
a
44
preschool
scholarship
is
requested,
the
parent
or
45
guardian
of
the
pupil
requesting
to
receive
the
46
preschool
scholarship
shall
submit
an
application
to
47
the
department
of
management,
on
application
forms
48
developed
by
the
department,
indicating
that
the
parent
49
or
guardian
intends
to
enroll
the
child
in
preschool

services
offered
by
a
scholarship

provider.

a.
The
department
of
management
shall
assign
2
each
pupil
a
preschool
scholarship
in
an
amount
not
to
3
exceed
the
lesser
of
the
following:

(1)
The
regular
amount
charged
for
full-time
5
enrollment
in
the
preschool
services
offered
by
6
the
scholarship
preschool
provider
to
children
not
7
participating
in
the
preschool
scholarship
program.

(2)
Twenty-five
percent
of
the
regular
program
9
state
cost
per
pupil
during
the
school
year
in
which
10
the
child
participates
in
the
preschool
scholarship
11
program.

b.
The
department
of
management
shall
on
October
13
1
following
the
determination
of
the
amount
of
the
14
preschool
scholarship
for
each
approved
child
remit
15
that
amount
to
the
scholarship
preschool
provider
for
16
the
approved
child.

4.
A
preschool
scholarship
fund
is
created
in
the
18
state
treasury
under
the
control
of
the
department
19
of
management
consisting
of
moneys
appropriated
to
20
the
department
for
the
purpose
of
providing
preschool
21
scholarships
under
this
section.
For
the
fiscal
22
year
commencing
July
1,
2014,
and
each
succeeding
23
fiscal
year,
there
is
appropriated
from
the
general
24
fund
of
the
state
to
the
department
of
management
to
25
be
credited
to
the
fund
the
amount
necessary
to
pay
26
all
preschool
scholarships
approved
for
that
fiscal
27
year.
The
director
of
the
department
of
management
has
28
all
powers
necessary
to
carry
out
and
effectuate
the
29
purposes,
objectives,
and
provisions
of
this
section
30
pertaining
to
the
fund,
including
the
power
to
do
all
31
of
the
following:
32
a.
Make
and
enter
into
contracts
necessary
for
the
33
administration
of
the
fund.
34
b.
Procure
insurance
against
any
loss
in
connection
35
with
the
assets
of
the
fund
or
require
a
surety
bond.
36
c.
Contract
with
a
private
financial
management
37
firm
to
manage
the
fund,
in
collaboration
with
the
38
treasurer
of
state.
39
d.
Conduct
audits
or
other
review
necessary
to
40
properly
administer
the
program.
41
e.
Adopt
rules
pursuant
to
chapter
17A
for
the
42
administration
of
the
fund
and
accounts
within
the
43
fund.
