Page 18, after line 31 by inserting: 5 < DIVISION ___ 6 PERSONNEL SETTLEMENT AGREEMENTS 7 Sec. ___. AUDITOR OF STATE —— EXAMINATION OF 8 PERSONNEL SETTLEMENT AGREEMENTS. There is appropriated 9 from the general fund of the state to the auditor of 10 state for the fiscal year beginning July 1, 2013, and 11 ending June 30, 2014, the following amount, or so much 12 thereof as is necessary, to be used for the purposes 13 designated: 14 For costs associated with conducting an examination 15 of personnel settlement agreements: 16 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 10,000 17 Notwithstanding section 8.33, moneys appropriated in 18 this section that remain unencumbered or unobligated 19 at the close of the fiscal year shall not revert but 20 shall remain available for expenditure for the purposes 21 designated until the close of the succeeding fiscal 22 year. 23 Sec. ___. AUDITOR OF STATE EXAMINATION —— PERSONNEL 24 SETTLEMENT AGREEMENTS. From the moneys appropriated 25 in this Act, the auditor of state shall expend such 26 amount as is necessary for purposes of conducting an 27 examination concerning personnel settlement agreements 28 made by the state with terminated state employees since 29 January 2011 that were not approved by the state appeal 30 board or decided by the public employment relations 31 board. The examination shall include the nature of 32 the positions subject to termination, the payments 33 provided and the funding source of the payments, and 34 the identity and authority of the person or persons 35 signing the personnel settlement agreement on behalf 36 of the state. 37 Sec. ___. EFFECTIVE UPON ENACTMENT. This division 38 of this Act, being deemed of immediate importance, 39 takes effect upon enactment. 40 Sec. ___. RETROACTIVE APPLICABILITY. This division 41 of this Act applies retroactively to July 1, 2013. > 42 5.
