If the 14 department determines that a safety issue continues 15 to require a child to reside outside of the child’s 16 home at the conclusion of a family assessment, the 17 department shall transfer the assessment to the child 18 abuse assessment pathway for a disposition. 19 NEW SUBSECTION . 13B. Conclusion of family 20 assessment. At the conclusion of a family assessment, 21 the department shall transfer the case, if appropriate, 22 to a contracted provider to review the service plan for 23 the child and family. The contracted provider shall 24 make a referral to the department abuse hotline if a 25 family’s noncompliance with a service plan places a 26 child at risk. If any of the criteria for child abuse 27 as defined in section 232.68, subsection 2, paragraph 28 “a” , are met, the department shall commence a child 29 abuse assessment. If any of the criteria for a child 30 in need of assistance, as defined in section 232.2, 31 subsection 6, are met, the department shall determine 32 whether to request a child in need of assistance 33 petition. > 34 3.
