Section 598.41A, Code 2013, is amended 4 to read as follows: 5 598.41A Visitation —— history of crimes against a 6 minor. 7 1. Notwithstanding section 598.41 , the court shall 8 consider, in the award of visitation rights to a parent 9 of a child, the criminal history of the parent if the 10 parent has been convicted of a sex offense against a 11 minor as defined in section 692A.101 . 12 2. Notwithstanding section 598.41, an individual 13 who is a parent of a minor child and who has been 14 convicted of a sex offense against a minor as defined 15 in section 692A.101, is not entitled to visitation 16 rights while incarcerated. While on probation, parole, 17 or any other type of conditional release including a 18 special sentence for such offense, visitation shall 19 be denied until the parent successfully completes a 20 treatment program approved by the court, if required 21 by the court. The circumstances described in this 22 subsection shall be considered a substantial change in 23 circumstances. > 24 2. Page 2, after line 1 by inserting: 25 < Sec. ___. EFFECTIVE UPON ENACTMENT.
