House Amendment to Senate File 386 S-3180 Amend Senate File 386, as passed by the Senate, as 1 follows: 2 1. Page 1, after line 9 by inserting: 3 < Sec. ___. Section 321.1, subsections 12A, 37, 59, 4 and 74, Code 2013, are amended to read as follows: 5 12A. “Completed motor vehicle” means a motor vehicle 6 which does not require any additional manufacturing 7 operations to perform its intended function except the 8 addition of readily attachable equipment, components, 9 or minor finishing operations. “Completed motor 10 vehicle ” also includes a glider kit vehicle. 11 37. “Manufacturer” means every person engaged in 12 the business of fabricating or assembling vehicles of 13 a type required to be registered. It “Manufacturer” 14 does not include a person who converts, modifies, 15 or alters a completed motor vehicle manufactured by 16 another person or a person who assembles a glider kit 17 vehicle . It “Manufacturer” includes a person who uses 18 a completed motor vehicle manufactured by another 19 person to construct a class “B” motor home as defined 20 in section 321.124 . 21 59. “Reconstructed vehicle” means every vehicle of 22 a type required to be registered under this chapter 23 materially altered from its original construction by 24 the removal, addition, or substitution of essential 25 parts, new or used. “Reconstructed vehicle” does not 26 include a street rod , or replica vehicle , or glider kit 27 vehicle . 28 74. “Specially constructed vehicle” means every 29 vehicle of a type required to be registered under 30 this chapter not originally constructed under a 31 distinctive name, make, model, or type by a generally 32 recognized manufacturer of vehicles and not materially 33 altered from its original construction. Section 321.1, Code 2013, is amended by 38 adding the following new subsection: 39 NEW SUBSECTION . 28B. “Glider kit vehicle” means 40 a commercial motor vehicle, as defined in subsection 41 11, that is a combination of a new cab and a new frame 42 with an engine, transmission, and drive axle that are 43 not new such that the resulting vehicle is not a newly 44 manufactured vehicle pursuant to 49 C.F.R. § 571.7(e). > 45 3. Section 321.453, Code 2013, is amended 4 to read as follows: 5 321.453 Exceptions. 6 The provisions of this chapter governing size, 7 weight, and load, and the permit requirements 8 of chapter 321E do not apply to fire any of the 9 following: > 10 1. Fire apparatus ; road . > 11 2. Road maintenance equipment owned by, or under 12 lease to, a state or local authority, or used in 13 the performance of a contract with any a state or 14 local authority ; or to implements . Upon application 15 by the owner of road maintenance equipment used in 16 the performance of a contract with a state or local 17 authority or a private entity, the department may waive 18 a provision of this chapter governing size, weight, 19 or load or a permit requirement of chapter 321E to 20 allow operation of the road maintenance equipment 21 for purposes not related to the performance of the 22 contract. > 23 3. Implements of husbandry moved or moving upon a 24 highway, except for those implements of husbandry moved 25 or moving on any portion of the interstate and except 26 as provided in sections 321.463 , 321.471 , and 321.474 . 27 A vehicle, carrying an implement of husbandry, which 28 is exempted from the permit requirements under this 29 section shall be equipped with an amber flashing light 30 visible from the rear. If the amber flashing light 31 is obstructed by the loaded implement, the loaded 32 implement shall also be equipped with and display 33 an amber flashing light. The vehicle shall also be 34 equipped with warning flags on that portion of the 35 vehicle which protrudes into oncoming traffic, and 36 shall only operate from thirty minutes prior to sunrise 37 to thirty minutes following sunset. > 38 5.
