GOALS AND ACCOUNTABILITY —— ECONOMIC 14 DEVELOPMENT. 15 1. For the fiscal year beginning July 1, 2013, the 16 goals for the economic development authority shall be 17 to expand and stimulate the state economy, increase the 18 wealth of Iowans, and increase the population of the 19 state. 20 2. To achieve the goals in subsection 1, the 21 economic development authority shall do all of the 22 following for the fiscal year beginning July 1, 2013: 23 a. Concentrate its efforts on programs and 24 activities that result in commercially viable products 25 and services. 26 b. Adopt practices and services consistent with 27 free market, private sector philosophies. 28 c. Ensure economic growth and development 29 throughout the state. 30 d. Work with businesses and communities to 31 continually improve the economic development climate 32 along with the economic well-being and quality of life 33 for Iowans. 34 e. Coordinate with other state agencies to 35 ensure that they are attentive to the needs of an 36 entrepreneurial culture. 37 f. Establish a strong and aggressive marketing 38 image to showcase Iowa’s workforce, existing industry, 39 and potential. A priority shall be placed on 40 recruiting new businesses, business expansion, and 41 retaining existing Iowa businesses. Emphasis shall be 42 placed on entrepreneurial development through helping 43 entrepreneurs secure capital, and developing networks 44 and a business climate conducive to entrepreneurs and 45 small businesses. 46 g. Encourage the development of communities and 47 quality of life to foster economic growth. 48 h. Prepare communities for future growth and 49 development through development, expansion, and 50 -2- SF430.1681.H (1) 85 md 2/ 29
modernization of infrastructure. 1 i. Develop public-private partnerships with 2 Iowa businesses in the tourism industry, Iowa tour 3 groups, Iowa tourism organizations, and political 4 subdivisions in this state to assist in the development 5 of advertising efforts. 6 j. Develop, to the fullest extent possible, 7 cooperative efforts for advertising with contributions 8 from other sources. 9 Sec. 3. ECONOMIC DEVELOPMENT AUTHORITY. 10 1. APPROPRIATION 11 a. (1) For salaries, support, miscellaneous 21 purposes, programs, marketing, and the maintenance of 22 an administration division, a business development 23 division, a community development division, a small 24 business development division, and other divisions the 25 authority may organize. 26 (2) The full-time equivalent positions authorized 27 under this section shall be funded, in whole or in 28 part, by the moneys appropriated under this subsection 29 or by other moneys received by the authority, including 30 certain federal moneys. 31 (3) For business development operations and 32 programs, international trade, export assistance, 33 workforce recruitment, and the partner state program. 34 (4) For transfer to the strategic investment fund 35 created in section 15.313. 36 (5) For community economic development programs, 37 tourism operations, community assistance, plans 38 for Iowa green corps and summer youth programs, 39 the mainstreet and rural mainstreet programs, the 40 school-to-career program, the community development 41 block grant, and housing and shelter-related programs. 42 (6) For achieving the goals and accountability, and 43 fulfilling the requirements and duties required under 44 this Act. 45 c. Notwithstanding section 8.33, moneys 46 appropriated in this subsection that remain 47 unencumbered or unobligated at the close of the fiscal 48 year shall not revert but shall remain available 49 for expenditure for the purposes designated in this 50 -3- SF430.1681.H (1) 85 md 3/ 29
subsection until the close of the succeeding fiscal 1 year. 2 2. FINANCIAL ASSISTANCE RESTRICTIONS 3 a. A business creating jobs through moneys 4 appropriated in subsection 1 shall be subject to 5 contract provisions requiring new and retained jobs to 6 be filled by individuals who are citizens of the United 7 States who reside within the United States or any 8 person authorized to work in the United States pursuant 9 to federal law, including legal resident aliens in the 10 United States. 11 b. Any vendor who receives moneys appropriated in 12 subsection 1 shall adhere to such contract provisions 13 and provide periodic assurances as the state shall 14 require that the jobs are filled solely by citizens of 15 the United States who reside within the United States 16 or any person authorized to work in the United States 17 pursuant to federal law, including legal resident 18 aliens in the United States. 19 c. A business that receives financial assistance 20 from the authority from moneys appropriated in 21 subsection 1 shall only employ individuals legally 22 authorized to work in this state. In addition to all 23 other applicable penalties provided by current law, all 24 or a portion of the assistance received by a business 25 which is found to knowingly employ individuals not 26 legally authorized to work in this state is subject to 27 recapture by the authority. 28 3. USES OF APPROPRIATIONS 29 a. From the moneys appropriated in subsection 1, 30 the authority may provide financial assistance in the 31 form of a grant to a community economic development 32 entity for conducting a local workforce recruitment 33 effort designed to recruit former citizens of the state 34 and former students at colleges and universities in the 35 state to meet the needs of local employers. 36 b. From the moneys appropriated in subsection 1, 37 the authority may provide financial assistance to early 38 stage industry companies being established by women 39 entrepreneurs. 40 c. From the moneys appropriated in subsection 1, 41 the authority may provide financial assistance in the 42 form of grants, loans, or forgivable loans for advanced 43 research and commercialization projects involving 44 value-added agriculture, advanced technology, or 45 biotechnology. 46 d. The authority shall not use any moneys 47 appropriated in subsection 1 for purposes of providing 48 financial assistance for the Iowa green streets pilot 49 project or for any other program or project that 50 -4- SF430.1681.H (1) 85 md 4/ 29
involves the installation of geothermal systems for 1 melting snow and ice from streets or sidewalks. 2 4. WORLD FOOD PRIZE 3 There is appropriated from the general fund of the 4 state to the economic development authority for the 5 fiscal year beginning July 1, 2013, and ending June 30, 6 2014, the following amount for the world food prize 7 and in lieu of the standing appropriation in section 8 15.368, subsection 1 : 9 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 750,000 10 5. EMPLOYEE STOCK OWNERSHIP PLANS FORMATION 33 ASSISTANCE 34 a. There is appropriated from the general fund of 35 the state to the economic development authority for the 36 fiscal year beginning July 1, 2013, and ending June 30, 37 2014, the following amount to be used for the providing 38 of financial assistance, including establishment of 39 a loan program, and technical assistance, marketing, 40 and education to businesses interested in establishing 41 employee stock ownership plans and for procuring the 42 services of an independent contractor with expertise in 43 the formation of the employee stock ownership plans: 44 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 400,000 45 Notwithstanding section 8.33, moneys appropriated in 46 this subsection that remain unencumbered or unobligated 47 at the close of the fiscal year shall not revert but 48 shall remain available for expenditure for the purposes 49 designated until the close of the succeeding fiscal 50 -5- SF430.1681.H (1) 85 md 5/ 29

Notwithstanding section 12C.7, subsection 2, 1 earnings or interest on moneys appropriated pursuant 2 to this subsection shall be retained by the economic 3 development authority and used for the purposes 4 designated until expended. 5 b. On or before January 15, 2015, the authority 6 shall submit a report to the general assembly and the 7 governor’s office describing the expenditure of funds 8 pursuant to this subsection and evaluating the success 9 of the assistance and promotion program. 10 7. COUNCILS OF GOVERNMENTS —— ASSISTANCE 11 There is appropriated from the general fund of the 12 state to the economic development authority for the 13 fiscal year beginning July 1, 2013, and ending June 30, 14 2014, the following amount to be used for the purposes 15 of providing financial assistance to Iowa’s councils 16 of governments: 17 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 175,000 18 Sec. 4. VISION IOWA PROGRAM —— FTE 19 AUTHORIZATION. For purposes of administrative 20 duties associated with the vision Iowa program for 21 the fiscal year beginning July 1, 2013, the economic 22 development authority is authorized an additional 2.25 23 FTEs above those otherwise authorized in this division 24 of this Act. 25 Sec. 5. INSURANCE ECONOMIC DEVELOPMENT. From 26 the moneys collected by the division of insurance in 27 excess of the anticipated gross revenues under section 28 505.7, subsection 3 , during the fiscal year beginning 29 July 1, 2013, $100,000 shall be transferred to the 30 economic development authority for insurance economic 31 development and international insurance economic 32 development. 33 Sec. 6. WORKFORCE DEVELOPMENT FUND. There is 34 appropriated from the workforce development fund 35 account created in section 15.342A to the workforce 36 development fund created in section 15.343 for the 37 fiscal year beginning July 1, 2013, and ending June 38 30, 2014, the following amount, for purposes of the 39 workforce development fund: 40 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 4,000,000 41 Sec. 7. IOWA STATE UNIVERSITY. 42 1. There is appropriated from the general fund 43 of the state to Iowa state university of science 44 and technology for the fiscal year beginning July 45 1, 2013, and ending June 30, 2014, the following 46 amount, or so much thereof as is necessary, to be used 47 for small business development centers, the science 48 and technology research park, and the institute for 49 physical research and technology, and for not more than 50 -6- SF430.1681.H (1) 85 md 6/ 29

Of the moneys appropriated in subsection 1, 4 Iowa state university of science and technology shall 5 allocate at least $735,728 for purposes of funding 6 small business development centers. Iowa state 7 university of science and technology may allocate 8 moneys appropriated in subsection 1 to the various 9 small business development centers in any manner 10 necessary to achieve the purposes of this subsection. 11 3. Iowa state university of science and technology 12 shall do all of the following: 13 a. Direct expenditures for research toward projects 14 that will provide economic stimulus for Iowa. 15 b. Provide emphasis to providing services to 16 Iowa-based companies. 17 4. It is the intent of the general assembly 18 that the industrial incentive program focus on Iowa 19 industrial sectors and seek contributions and in-kind 20 donations from businesses, industrial foundations, and 21 trade associations, and that moneys for the institute 22 for physical research and technology industrial 23 incentive program shall be allocated only for projects 24 which are matched by private sector moneys for directed 25 contract research or for nondirected research. The 26 match required of small businesses as defined in 27 section 15.102, subsection 10 , for directed contract 28 research or for nondirected research shall be $1 for 29 each $3 of state funds. The match required for other 30 businesses for directed contract research or for 31 nondirected research shall be $1 for each $1 of state 32 funds. The match required of industrial foundations 33 or trade associations shall be $1 for each $1 of state 34 funds. 35 Iowa state university of science and technology 36 shall report annually to the joint appropriations 37 subcommittee on economic development and the 38 legislative services agency the total amount of 39 private contributions, the proportion of contributions 40 from small businesses and other businesses, and 41 the proportion for directed contract research and 42 nondirected research of benefit to Iowa businesses and 43 industrial sectors. 44 5. REGENTS INNOVATION FUND. 5 1. There is appropriated from the general fund 6 of the state to the state board of regents for the 7 fiscal year beginning July 1, 2013, and ending June 30, 8 2014, the following amount to be used for the purposes 9 provided in this section: 10 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 3,000,000 11 Of the moneys appropriated pursuant to this 12 section, 35 percent shall be allocated for Iowa state 13 university, 35 percent shall be allocated for the 14 university of Iowa, and 30 percent shall be allocated 15 for the university of northern Iowa. 16 2. The institutions shall use moneys appropriated 17 in this section for capacity building infrastructure 18 in areas related to technology commercialization, 19 marketing and business development efforts in 20 areas related to technology commercialization, 21 entrepreneurship, and business growth, and 22 infrastructure projects and programs needed to assist 23 in implementation of activities under chapter 262B. 24 3. The institutions shall provide a one-to-one 25 match of additional moneys for the activities funded 26 with moneys appropriated under this section. 27 4. The state board of regents shall annually submit 28 a report by January 15 of each year to the governor, 29 the general assembly, and the legislative services 30 agency regarding the activities, projects, and programs 31 funded with moneys allocated under this section. The 32 report shall be provided in an electronic format and 33 shall include a list of metrics and criteria mutually 34 agreed to in advance by the board of regents and 35 the economic development authority. The metrics and 36 criteria shall allow the governor’s office and the 37 general assembly to quantify and evaluate the progress 38 of the board of regents institutions with regard to 39 their activities, projects, and programs in the areas 40 of technology commercialization, entrepreneurship, 41 regional development, and market research. 42 5. Notwithstanding section 8.33, moneys 43 appropriated in this section that remain unencumbered 44 or unobligated at the close of the fiscal year shall 45 not revert but shall remain available for expenditure 46 for the purposes designated until the close of the 47 succeeding fiscal year. 48 Sec. 11. BOARD OF REGENTS REPORT. The state board 49 of regents shall submit a report on the progress of 50 -9- SF430.1681.H (1) 85 md 9/ 29
regents institutions in meeting the strategic plan for 1 technology transfer and economic development to the 2 secretary of the senate, the chief clerk of the house 3 of representatives, and the legislative services agency 4 by January 15, 2014. 5 Sec. 12. IOWA FINANCE AUTHORITY. 6 1. There is appropriated from the general fund 7 of the state to the Iowa finance authority for the 8 fiscal year beginning July 1, 2013, and ending June 30, 9 2014, the following amount, or so much thereof as is 10 necessary, to be used to provide reimbursement for rent 11 expenses to eligible persons under the rent subsidy 12 program: 13 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 658,000 14 2. Participation in the rent subsidy program 15 shall be limited to only those persons who meet the 16 requirements for the nursing facility level of care for 17 home and community-based services waiver services as in 18 effect on July 1, 2013, and to those individuals who 19 are eligible for the federal money follows the person 20 grant program under the medical assistance program. Of 21 the moneys appropriated in this section, not more than 22 $35,000 may be used for administrative costs. 23 Sec. 13. IOWA FINANCE AUTHORITY AUDIT. The auditor 24 of state is requested to review the audit of the Iowa 25 finance authority performed by the auditor hired by the 26 authority. 27 Sec. 14. PUBLIC EMPLOYMENT RELATIONS BOARD. 28 1. Notwithstanding 2 section 96.9, subsection 4 , paragraph “a”, moneys 3 credited to the state by the secretary of the treasury 4 of the United States pursuant to section 903 of 5 the Social Security Act are appropriated to the 6 department of workforce development and shall be 7 used by the department for the administration of 8 the unemployment compensation program only. GOALS AND ACCOUNTABILITY —— ECONOMIC 21 DEVELOPMENT. 22 1. For the fiscal year beginning July 1, 2014, the 23 goals for the economic development authority shall be 24 to expand and stimulate the state economy, increase the 25 wealth of Iowans, and increase the population of the 26 state. 27 2. To achieve the goals in subsection 1, the 28 economic development authority shall do all of the 29 following for the fiscal year beginning July 1, 2014: 30 a. Concentrate its efforts on programs and 31 activities that result in commercially viable products 32 and services. 33 b. Adopt practices and services consistent with 34 free market, private sector philosophies. 35 c. Ensure economic growth and development 36 throughout the state. 37 d. Work with businesses and communities to 38 continually improve the economic development climate 39 along with the economic well-being and quality of life 40 for Iowans. 41 e. Coordinate with other state agencies to 42 ensure that they are attentive to the needs of an 43 entrepreneurial culture. 44 f. Establish a strong and aggressive marketing 45 image to showcase Iowa’s workforce, existing industry, 46 and potential. A priority shall be placed on 47 recruiting new businesses, business expansion, and 48 retaining existing Iowa businesses. Emphasis shall be 49 placed on entrepreneurial development through helping 50 -14- SF430.1681.H (1) 85 md 14/ 29
entrepreneurs secure capital, and developing networks 1 and a business climate conducive to entrepreneurs and 2 small businesses. 3 g. Encourage the development of communities and 4 quality of life to foster economic growth. 5 h. Prepare communities for future growth and 6 development through development, expansion, and 7 modernization of infrastructure. 8 i. Develop public-private partnerships with 9 Iowa businesses in the tourism industry, Iowa tour 10 groups, Iowa tourism organizations, and political 11 subdivisions in this state to assist in the development 12 of advertising efforts. 13 j. Develop, to the fullest extent possible, 14 cooperative efforts for advertising with contributions 15 from other sources. 16 Sec. 23. ECONOMIC DEVELOPMENT AUTHORITY. 17 1. APPROPRIATION 18 a. There is appropriated from the general fund of 19 the state to the economic development authority for the 20 fiscal year beginning July 1, 2014, and ending June 30, 21 2015, the following amount, or so much thereof as is 22 necessary, to be used for the purposes designated in 23 this subsection, and for not more than the following 24 full-time equivalent positions: 25 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 11,240,760 26 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . (1) For salaries, support, miscellaneous 28 purposes, programs, marketing, and the maintenance of 29 an administration division, a business development 30 division, a community development division, a small 31 business development division, and other divisions the 32 authority may organize. 33 (2) The full-time equivalent positions authorized 34 under this section shall be funded, in whole or in 35 part, by the moneys appropriated under this subsection 36 or by other moneys received by the authority, including 37 certain federal moneys. 38 (3) For business development operations and 39 programs, international trade, export assistance, 40 workforce recruitment, and the partner state program. 41 (4) For transfer to the strategic investment fund 42 created in section 15.313. 43 (5) For community economic development programs, 44 tourism operations, community assistance, plans 45 for Iowa green corps and summer youth programs, 46 the mainstreet and rural mainstreet programs, the 47 school-to-career program, the community development 48 block grant, and housing and shelter-related programs. 49 (6) For achieving the goals and accountability, and 50 -15- SF430.1681.H (1) 85 md 15/ 29
fulfilling the requirements and duties required under 1 this Act. 2 c. Notwithstanding section 8.33, moneys 3 appropriated in this subsection that remain 4 unencumbered or unobligated at the close of the fiscal 5 year shall not revert but shall remain available 6 for expenditure for the purposes designated in this 7 subsection until the close of the succeeding fiscal 8 year. 9 2. FINANCIAL ASSISTANCE RESTRICTIONS 10 a. A business creating jobs through moneys 11 appropriated in subsection 1 shall be subject to 12 contract provisions requiring new and retained jobs to 13 be filled by individuals who are citizens of the United 14 States who reside within the United States or any 15 person authorized to work in the United States pursuant 16 to federal law, including legal resident aliens in the 17 United States. 18 b. Any vendor who receives moneys appropriated in 19 subsection 1 shall adhere to such contract provisions 20 and provide periodic assurances as the state shall 21 require that the jobs are filled solely by citizens of 22 the United States who reside within the United States 23 or any person authorized to work in the United States 24 pursuant to federal law, including legal resident 25 aliens in the United States. 26 c. A business that receives financial assistance 27 from the authority from moneys appropriated in 28 subsection 1 shall only employ individuals legally 29 authorized to work in this state. In addition to all 30 other applicable penalties provided by current law, all 31 or a portion of the assistance received by a business 32 which is found to knowingly employ individuals not 33 legally authorized to work in this state is subject to 34 recapture by the authority. 35 3. USES OF APPROPRIATIONS 36 a. From the moneys appropriated in subsection 1, 37 the authority may provide financial assistance in the 38 form of a grant to a community economic development 39 entity for conducting a local workforce recruitment 40 effort designed to recruit former citizens of the state 41 and former students at colleges and universities in the 42 state to meet the needs of local employers. 43 b. From the moneys appropriated in subsection 1, 44 the authority may provide financial assistance to early 45 stage industry companies being established by women 46 entrepreneurs. 47 c. From the moneys appropriated in subsection 1, 48 the authority may provide financial assistance in the 49 form of grants, loans, or forgivable loans for advanced 50 -16- SF430.1681.H (1) 85 md 16/ 29
research and commercialization projects involving 1 value-added agriculture, advanced technology, or 2 biotechnology. 3 d. The authority shall not use any moneys 4 appropriated in subsection 1 for purposes of providing 5 financial assistance for the Iowa green streets pilot 6 project or for any other program or project that 7 involves the installation of geothermal systems for 8 melting snow and ice from streets or sidewalks. 9 4. WORLD FOOD PRIZE 10 There is appropriated from the general fund of the 11 state to the economic development authority for the 12 fiscal year beginning July 1, 2014, and ending June 30, 13 2015, the following amount for the world food prize 14 and in lieu of the standing appropriation in section 15 15.368, subsection 1 : 16 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 637,500 17 5. EMPLOYEE STOCK OWNERSHIP PLANS FORMATION 40 ASSISTANCE 41 There is appropriated from the general fund of the 42 state to the economic development authority for the 43 fiscal year beginning July 1, 2014, and ending June 30, 44 2015, the following amount to be used for the providing 45 of financial assistance, including establishment of 46 a loan program, and technical assistance, marketing, 47 and education to businesses interested in establishing 48 employee stock ownership plans and for procuring the 49 services of an independent contractor with expertise in 50 -17- SF430.1681.H (1) 85 md 17/ 29
the formation of the employee stock ownership plans: 1 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 340,000 2 Notwithstanding section 8.33, moneys appropriated in 3 this subsection that remain unencumbered or unobligated 4 at the close of the fiscal year shall not revert but 5 shall remain available for expenditure for the purposes 6 designated until the close of the succeeding fiscal 7 year. Notwithstanding section 12C.7, subsection 2, 8 earnings or interest on moneys appropriated pursuant 9 to this subsection shall be retained by the economic 10 development authority and used for the purposes 11 designated until expended. 12 7. COUNCILS OF GOVERNMENTS —— ASSISTANCE 13 There is appropriated from the general fund of the 14 state to the economic development authority for the 15 fiscal year beginning July 1, 2014, and ending June 30, 16 2015, the following amount to be used for the purposes 17 of providing financial assistance to Iowa’s councils 18 of governments: 19 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 148,750 20 Sec. 24. VISION IOWA PROGRAM —— FTE 21 AUTHORIZATION. For purposes of administrative 22 duties associated with the vision Iowa program for 23 the fiscal year beginning July 1, 2014, the economic 24 development authority is authorized an additional 2.25 25 FTEs above those otherwise authorized in this division 26 of this Act. 27 Sec. 25. INSURANCE ECONOMIC DEVELOPMENT. From 28 the moneys collected by the division of insurance in 29 excess of the anticipated gross revenues under section 30 505.7, subsection 3 , during the fiscal year beginning 31 July 1, 2014, $100,000 shall be transferred to the 32 economic development authority for insurance economic 33 development and international insurance economic 34 development. 35 Sec. 26. WORKFORCE DEVELOPMENT FUND. There is 36 appropriated from the workforce development fund 37 account created in section 15.342A to the workforce 38 development fund created in section 15.343 for the 39 fiscal year beginning July 1, 2014, and ending June 40 30, 2015, the following amount, for purposes of the 41 workforce development fund: 42 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 3,400,000 43 Sec. 27. Iowa state 9 university of science and technology may allocate 10 moneys appropriated in subsection 1 to the various 11 small business development centers in any manner 12 necessary to achieve the purposes of this subsection. 13 3. Iowa state university of science and technology 14 shall do all of the following: 15 a. Direct expenditures for research toward projects 16 that will provide economic stimulus for Iowa. 17 b. Provide emphasis to providing services to 18 Iowa-based companies. 19 4. It is the intent of the general assembly 20 that the industrial incentive program focus on Iowa 21 industrial sectors and seek contributions and in-kind 22 donations from businesses, industrial foundations, and 23 trade associations, and that moneys for the institute 24 for physical research and technology industrial 25 incentive program shall be allocated only for projects 26 which are matched by private sector moneys for directed 27 contract research or for nondirected research. The 28 match required of small businesses as defined in 29 section 15.102, subsection 10 , for directed contract 30 research or for nondirected research shall be $1 for 31 each $3 of state funds. The match required for other 32 businesses for directed contract research or for 33 nondirected research shall be $1 for each $1 of state 34 funds. The match required of industrial foundations 35 or trade associations shall be $1 for each $1 of state 36 funds. 37 Iowa state university of science and technology 38 shall report annually to the joint appropriations 39 subcommittee on economic development and the 40 legislative services agency the total amount of 41 private contributions, the proportion of contributions 42 from small businesses and other businesses, and 43 the proportion for directed contract research and 44 nondirected research of benefit to Iowa businesses and 45 industrial sectors. 46 5. Notwithstanding section 8.33 , moneys 47 appropriated in this section that remain unencumbered 48 or unobligated at the close of the fiscal year shall 49 not revert but shall remain available for expenditure 50 -19- SF430.1681.H (1) 85 md 19/ 29

The institutions shall use moneys appropriated 19 in this section for capacity building infrastructure 20 in areas related to technology commercialization, 21 marketing and business development efforts in 22 areas related to technology commercialization, 23 entrepreneurship, and business growth, and 24 infrastructure projects and programs needed to assist 25 in implementation of activities under chapter 262B. 26 3. The institutions shall provide a one-to-one 27 match of additional moneys for the activities funded 28 with moneys appropriated under this section. 29 4. The state board of regents shall annually submit 30 a report by January 15 of each year to the governor, 31 the general assembly, and the legislative services 32 agency regarding the activities, projects, and programs 33 funded with moneys allocated under this section. The 34 report shall be provided in an electronic format and 35 shall include a list of metrics and criteria mutually 36 agreed to in advance by the board of regents and 37 the economic development authority. The metrics and 38 criteria shall allow the governor’s office and the 39 general assembly to quantify and evaluate the progress 40 of the board of regents institutions with regard to 41 their activities, projects, and programs in the areas 42 of technology commercialization, entrepreneurship, 43 regional development, and market research. 44 5. Notwithstanding section 8.33, moneys 45 appropriated in this section that remain unencumbered 46 or unobligated at the close of the fiscal year shall 47 not revert but shall remain available for expenditure 48 for the purposes designated until the close of the 49 succeeding fiscal year. 50 -21- SF430.1681.H (1) 85 md 21/ 29
Sec. 31. BOARD OF REGENTS REPORT. The state board 1 of regents shall submit a report on the progress of 2 regents institutions in meeting the strategic plan for 3 technology transfer and economic development to the 4 secretary of the senate, the chief clerk of the house 5 of representatives, and the legislative services agency 6 by January 15, 2015. 7 Sec. 32. IOWA FINANCE AUTHORITY. 8 1. There is appropriated from the general fund 9 of the state to the Iowa finance authority for the 10 fiscal year beginning July 1, 2014, and ending June 30, 11 2015, the following amount, or so much thereof as is 12 necessary, to be used to provide reimbursement for rent 13 expenses to eligible persons under the rent subsidy 14 program: 15 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 559,300 16 2. Participation in the rent subsidy program 17 shall be limited to only those persons who meet the 18 requirements for the nursing facility level of care for 19 home and community-based services waiver services as in 20 effect on July 1, 2014, and to those individuals who 21 are eligible for the federal money follows the person 22 grant program under the medical assistance program. Of 23 the moneys appropriated in this section, not more than 24 $35,000 may be used for administrative costs. 25 Sec. 33. IOWA FINANCE AUTHORITY AUDIT. The auditor 26 of state is requested to review the audit of the Iowa 27 finance authority performed by the auditor hired by the 28 authority. 29 Sec. 34. PUBLIC EMPLOYMENT RELATIONS BOARD. 30 1. The moneys generated by the filing 27 fee allowed under this subsection are appropriated to 28 the department of workforce development to be used for 29 purposes of administering the division of workers’ 30 compensation. 31 3. require a unique identification login for all users 1 of workforce development centers operated through 2 electronic means. 3 Sec. 40. UNEMPLOYMENT COMPENSATION PROGRAM. Notwithstanding 4 section 96.9, subsection 4 , paragraph “a”, moneys 5 credited to the state by the secretary of the treasury 6 of the United States pursuant to section 903 of 7 the Social Security Act are appropriated to the 8 department of workforce development and shall be 9 used by the department for the administration of 10 the unemployment compensation program only. This 11 appropriation shall not apply to any fiscal year 12 beginning after December 31, 2014. 13 DIVISION III 14 MISCELLANEOUS PROVISIONS 15 Sec. 41. Section 15.251, Code 2013, is amended to 16 read as follows: 17 15.251 Industrial new job training program 18 certificates —— fee. 19 The authority may charge, within thirty days 20 following the sale of certificates under chapter 260E , 21 the board of directors of the merged area a fee of 22 up to one percent of the gross sale amount of the 23 certificates issued. The amount of this fee shall be 24 deposited and allowed to accumulate in a job training 25 fund created in the authority. At the end of each 26 fiscal year, all funds deposited under this subsection 27 into the job training fund during the fiscal year 28 shall be transferred to the workforce development fund 29 account established in section 15.342A Moneys in the 30 fund are appropriated to the authority for purposes 31 of workforce development program coordination and 32 activities including salaries, support, maintenance, 33 legal and compliance, and miscellaneous purposes . 34 Sec. 42. Section 90A.7, Code 2013, is amended to 35 read as follows: 36 90A.7 Rules. 37 1. The commissioner shall adopt rules, pursuant 38 to chapter 17A , that the commissioner determines are 39 reasonably necessary to administer and enforce this 40 chapter . 41 2. The commissioner shall adopt rules establishing 42 an event fee to cover the costs of the administration 43 of this chapter. 44 3. The commissioner may adopt the rules of a 45 recognized national or world boxing organization that 46 sanctions a boxing match in this state to regulate the 47 match if the organization’s rules provide protection to 48 the boxers participating in the match which is equal 49 to or greater than the protections provided by this 50 -25- SF430.1681.H (1) 85 md 25/ 29
chapter or by rules adopted pursuant to this chapter . 1 As used in this paragraph, “recognized national or world 2 boxing organization” includes, but is not limited to, 3 the international boxing federation, the world boxing 4 association, and the world boxing council. 5 Sec. 43. Section 90A.10, subsection 1, Code 2013, 6 is amended to read as follows: 7 1. Moneys collected pursuant to sections 90A.3 and 8 section 90A.9 in excess of the amount of moneys needed 9 to administer this chapter from a professional boxing 10 event are appropriated to the department of workforce 11 development and shall be used by the commissioner to 12 award grants to organizations that promote amateur 13 boxing matches in this state. All other moneys 14 collected by the commissioner pursuant to this chapter 15 are appropriated to the department of workforce 16 development and shall be used by the commissioner to 17 administer this chapter. Section 8.33 applies only to 18 moneys in excess of the first twenty thousand dollars 19 appropriated each fiscal year. 20 Sec. 44. 2005 Iowa Acts, chapter 169, section 5, 21 subsection 6, is amended to read as follows: 22 6. Of the moneys appropriated in this section, 29 not more than $35,000 may be used for administrative 30 costs. 31 Sec. 53. 2012 Iowa Acts, chapter 1136, section 17, 32 is amended by adding the following new subsection: 33 NEW SUBSECTION . 5. Notwithstanding section 34 8.33, moneys appropriated in this section that remain 35 unencumbered or unobligated at the close of the fiscal 36 year shall not revert but shall remain available for 37 expenditure for the purposes designated until the close 38 of the succeeding fiscal year. 39 Sec. 54. EFFECTIVE UPON ENACTMENT. The sections 40 of this division of this Act amending 2011 Iowa Acts, 41 chapter 130, section 48, and 2012 Iowa Acts, chapter 42 1136, section 17, being deemed of immediate importance, 43 take effect upon enactment. 44 Sec. 55. RETROACTIVE APPLICABILITY. The section of 45 this Act amending 2005 Iowa Acts, chapter 169, applies 46 retroactively to July 1, 2005. 47 Sec. 56. RETROACTIVE APPLICABILITY.
