Section 422.11S, subsection 7, paragraph 3 a, subparagraph (2), Code 2013, is amended to read as 4 follows: 5 (2) “Total approved tax credits” means for the 6 tax year beginning in the 2006 calendar year, two 7 million five hundred thousand dollars, for the tax 8 year beginning in the 2007 calendar year, five million 9 dollars, and for the tax years year beginning on or 10 after January 1, 2008, but before January 1, 2012, 11 seven million five hundred thousand dollars . However, 12 for the tax years year beginning on or after January 1, 13 2012, “total approved tax credits” means eight million 14 seven hundred fifty thousand dollars , and for tax years 15 beginning on or after January 1, 2013, twenty million 16 dollars . 17 Sec. ___. Section 422.11S, Code 2013, is amended by 18 adding the following new subsection: 19 NEW SUBSECTION . 9. An individual may claim the 20 tax credit allowed under subsection 7 to a limited 21 liability company or S corporation electing to have the 22 income taxed directly to the individual. The amount 23 claimed by the individual shall be based upon the pro 24 rata share of the individual’s earnings of the limited 25 liability company or S corporation. > 26 2.
