The department of human services shall 14 amend the medical assistance state plan to provide 15 for coverage of adults up to 133 percent of the 16 federal poverty level as provided pursuant to section 17 249A.3, subsection 1, paragraph “v”, as enacted in 18 this Act, beginning January 1, 2014. The state plan 19 amendment shall include a provision specifying that if 20 the methodology for calculating the federal medical 21 assistance percentage for newly eligible individuals 22 under section 249A.3, subsection 1, paragraph “v”, 23 as provided in 42 U.S.C. § 1396d(y), is modified 24 through federal law or regulation before January 25 1, 2020, in a manner that reduces the percentage 26 of federal assistance to the state, the department 27 of human services shall implement an alternative 28 plan for coverage of the affected population, to the 29 extent necessary, so that state expenditures remain 30 budget neutral under the modified federal medical 31 assistance percentage relative to the percentage 32 specified for the same fiscal year under section 42 33 U.S.C. § 1396d(y). The state plan amendment shall 34 provide that implementation by the department of human 35 services of any alternative plan for coverage of the 36 affected population is subject to prior approval of the 37 implementation by statute. > 38 3.
