Section 256.9, Code 2013, is amended by 3 adding the following new subsection: 4 NEW SUBSECTION . 63. Transfer funds appropriated 5 pursuant to section 423F.2, subsection 3, to accredited 6 nonpublic schools to cover the costs of radon testing 7 and mitigation required by section 280.30. The 8 director shall establish an application process and 9 criteria for allocating such funds to accredited 10 nonpublic schools. > 11 2. Page 6, after line 17 by inserting: 12 < Sec. ___. Section 423F.2, subsection 3, Code 2013, 13 is amended to read as follows: 14 3. The moneys available in a fiscal year in the 15 secure an advanced vision for education fund shall be 16 distributed by the department of revenue to each school 17 district in an amount equal to the amount the school 18 district would have received pursuant to the formula 19 in section 423E.4 as if the local sales and services 20 tax for school infrastructure purposes was imposed. 21 Moneys in a fiscal year that are in excess of that 22 needed to provide each school district with its formula 23 amount are appropriated to the department of education 24 for transfer to accredited nonpublic schools pursuant 25 to section 256.9, subsection 63. Moneys in a fiscal 26 year that are in excess of that needed to provide each 27 school district with its formula amount and to cover 28 the costs associated with section 256.9, subsection 63, 29 shall be distributed and credited to the property tax 30 equity and relief fund created in section 257.16A . > 31 3.
