b.
(1)
The
department
of
economic
development

shall
approve
four
five
eligible
cities
as
pilot
17
project
cities,
one
pursuant
to
paragraph
“a”
,
18
subparagraph
(1),
one
pursuant
to
paragraph
“a”
,
19
subparagraph
(2),
and
two
pursuant
to
paragraph
20
“a”
,
subparagraph
(3)
,
and
one
pursuant
to
paragraph
21
“a”
,
subparagraph
(4)
.
The
city
approved
pursuant
22
to
paragraph
“a”
,
subparagraph
(4),
shall
have
a
23
population
of
at
least
eighty-five
thousand
six
hundred
24
residents
but
not
more
than
one
hundred
ten
thousand
25
residents,
which
city
shall
be
located
in
a
county
with
26
a
population
of
at
least
one
hundred
twenty
thousand
27
residents
but
not
more
than
one
hundred
seventy
28
thousand
residents,
as
determined
by
the
2010
certified
29
federal
census.
If
two
eligible
cities
are
approved
30
which
are
located
in
the
same
county
and
the
county
31
has
a
population
of
less
than
forty-five
thousand,
the
32
two
approved
eligible
cities
shall
be
considered
one
33
pilot
project
city.
If
more
than
two
cities
meeting
34
the
requirements
of
paragraph
“a”
,
subparagraph
(3),
35
apply
to
be
designated
as
a
pilot
project
city,
the
36
department
of
economic
development
shall
determine
37
which
two
cities
hold
the
most
potential
to
create
new
38
jobs
or
generate
the
greatest
capital
within
their
39
areas.
Applications
from
eligible
cities
seeking
40
approval
under
paragraph
“a”
,
subparagraph
(1),
(2),
or
41
(3),
filed
on
or
after
October
1,
2006,
shall
not
be
42
considered.
Applications
from
eligible
cities
seeking
43
approval
under
paragraph
“a”
,
subparagraph
(4),
filed
44
on
or
after
January
1,
2015,
shall
not
be
considered.

(2)
If
a
pilot
project
city
does
not
enter
into
a
46
withholding
agreement
within
one
year
of
its
approval
47
as
a
pilot
project
city,
the
city
shall
lose
its
48
status
as
a
pilot
project
city.
If
two
pilot
project
49
cities
are
located
in
the
same
county,
the
loss
of

one
pilot
project
city
shall
not
cause
the

second
pilot
project
city
in
the
county
to
lose
its

status
as
a
pilot
project
city.
Upon
such
occurrence,

the
department
of
economic
development
shall
take

applications
from
other
eligible
cities
to
replace
that
5
city.
Another
city
shall
be
designated
within
six
6
months.

(3)
On
July
1,
2011,
the
economic
development
8
authority
shall
assume
responsibility
for
the
9
administration
of
this
subsection
.
