However,
in
sharing
the
information,
the
department

shall
not
relinquish
control
of
the
information,
and

any
agreement
entered
into
by
the
department
with
14
federal
public
health
officials
to
share
information
15
shall
prohibit
the
use,
reproduction,
release,
or
16
disclosure
of
the
information
by
federal
public
health
17
officials
in
a
manner
which
violates
this
section
.

The
department
shall
publish,
annually,
a
demographic
19
summary
of
the
information
obtained
pursuant
to
20
this
section
,
except
that
the
department
shall
not
21
reproduce,
release,
or
disclose
any
information
22
obtained
pursuant
to
this
section
which
reveals
23
the
identity
of
any
patient,
health
care
provider,
24
hospital,
clinic,
or
other
health
facility,
and
shall
25
ensure
anonymity
in
the
following
ways:
26
a.
The
department
may
use
information
concerning
27
the
report
tracking
number
or
concerning
the
identity
28
of
a
reporting
health
care
provider,
hospital,
29
clinic,
or
other
health
facility
only
for
purposes
30
of
information
collection.
The
department
shall
not
31
reproduce,
release,
or
disclose
this
information
for
32
any
purpose
other
than
for
use
in
annually
publishing
33
the
demographic
summary
under
this
section
.
34
b.
The
department
shall
enter
the
information,
from
35
any
report
of
termination
submitted,
within
thirty
36
days
of
receipt
of
the
report,
and
shall
immediately
37
destroy
the
report
following
entry
of
the
information.
38
However,
entry
of
the
information
from
a
report
shall
39
not
include
any
health
care
provider,
hospital,
clinic,
40
or
other
health
facility
identification
information
41
including,
but
not
limited
to,
the
confidential
health
42
care
provider
code,
as
assigned
by
the
department.
43
c.
To
protect
confidentiality,
the
department
44
shall
limit
release
of
information
to
release
in
an
45
aggregate
form
which
prevents
identification
of
any
46
individual
patient,
health
care
provider,
hospital,
47
clinic,
or
other
health
facility.
For
the
purposes
of
48
this
paragraph,
“aggregate
form”
means
a
compilation
49
of
the
information
received
by
the
department
on

listed,
with
the
exceptions
of
the
report
tracking

number,
the
health
care
provider
code,

set

the
information
5
relates
may
be
compromised.
The
department
shall
6
establish
a
methodology
to
provide
a
statistically
7
verifiable
basis
for
any
determination
of
the
correct
8
amount
at
which
information
may
be
released
so
that
the
9
confidentiality
of
any
person
is
not
compromised.

fide
executive

position

entitled

annual
retirement

benefit
from
a
pension,
profit-sharing,
savings,
or

deferred
compensation
plan
of
the
employer
which
equals

twenty-seven
thousand
dollars.
This
retirement
benefit
36
test
may
be
adjusted
according
to
the
regulations

prescribed
by
the
United
States
secretary
of
labor

pursuant
to
Pub.
L.
No.
95-256,
section
3.

b.
The
involuntary
retirement
of
a
person
covered
40
by
a
collective
bargaining
agreement
which
was
entered
41
into
by
a
labor
organization
and
was
in
effect
on
42
September
1,
1977.
This
exemption
does
not
apply
after
43
the
termination
of
that
agreement
or
January
1,
1980,

whichever
first
occurs.

A
health
insurance
program
provided
by
an

may
exclude
coverage

intent

causing
an
abortion,

does
not
include
drugs

be
known
to
cause

an
abortion,
but
which
are
prescribed
for
other
medical

indications.
