The moneys shall be used to support a nationally 16 recognized program that began in 1986 and has been 17 replicated in at least 30 other states, but which 18 is not available through any other entity in this 19 state, and that provides assistance to farmers with 20 disabilities in all 99 counties to allow the farmers to 21 remain in their own homes and be gainfully engaged in 22 farming through provision of agricultural worksite and 23 home modification consultations, peer support services, 24 services to families, information and referral, and 25 equipment loan services. 26 b. The moneys appropriated in subsection 1 20 shall be used to support reducing nutrients projects 21 in subwatersheds as designated by the division that 22 are part of high-priority watersheds identified by 23 the water resources coordinating council established 24 pursuant to section 466B.3 . In supporting reducing 25 nutrients 26 b. The moneys appropriated in subsection 1 shall 27 be used to support projects in watersheds generally, 28 including regional watersheds, as designated by the 29 division and high-priority watersheds identified by 30 the water resources coordinating council established 31 pursuant to section 466B.3. 32 2A. In supporting projects in subwatersheds , the 33 division shall establish and administer demonstration 34 projects as follows and watersheds as provided in 35 subsection 2, all of the following shall apply : 36 a. The demonstration projects shall utilize water 37 quality practices as described in the latest revision 38 of the document entitled “Iowa Nutrient Reduction 39 Strategy” initially presented in November 2012 by 40 the department of agriculture and land stewardship, 41 the department of natural resources, and Iowa state 42 university of science and technology. 43 b. The division shall implement demonstration 44 projects as provided in paragraph “a” by providing for 45 participation by persons who hold a legal interest in 46 agricultural land used in farming. To every extent 47 practical, the division shall provide for collaborative 48 participation by such persons who hold a legal 49 interest in agricultural land located within the same 50 -5- HF2458.4103.S (2) 85 jh 5/ 21
subwatershed. 1 c. The division shall implement a demonstration 2 project on a cost-share basis as determined by the 3 division. However, the state’s share of the amount 4 shall not exceed 50 percent of the estimated cost of 5 establishing the practice as determined by the division 6 or 50 percent of the actual cost of establishing the 7 practice, whichever is less. 8 d. The demonstration projects shall be used to 9 educate other persons about the feasibility and value 10 of establishing similar water quality practices. The 11 division shall promote field day events for purposes of 12 allowing interested persons to establish water quality 13 practices on their agricultural land. 14 e. The division shall conduct water quality 15 evaluations within supported subwatersheds. Within 16 a reasonable period after accumulating information 17 from such evaluations, the division shall create an 18 aggregated database of water quality practices. Any 19 information identifying a person holding a legal 20 interest in agricultural land or specific agricultural 21 land shall be a confidential record under section 22.7 . 22 3. The moneys appropriated in subsection 1 shall 23 be used to support education and outreach in a manner 24 that encourages persons who hold a legal interest in 25 agricultural land used for farming to implement water 26 quality practices, including the establishment of such 27 practices in watersheds generally, and not limited to 28 subwatersheds or high-priority watersheds. 29 4. The moneys appropriated in subsection 1 may 30 be used to contract with persons to coordinate the 31 implementation of efforts provided in this section. 32 Not more than $150,000 shall be used to support 33 the administration of this section by a full-time 34 equivalent position. 35 4A. The moneys appropriated in subsection 1 may 36 be used by the department to support urban soil 37 and water conservation efforts, which may include 38 but are not limited to management practices related 39 to bioretention, landscaping, the use of permeable 40 pavement, and soil quality restoration. The moneys 41 shall be allocated on a cost-share basis as provided 42 in chapter 161A. 43 5. Notwithstanding any other provision of law 44 to the contrary, the department may use moneys 45 appropriated in subsection 1 to carry out the 46 provisions of this section on a cost-share basis in 47 combination with other moneys appropriated available to 48 the department from the environment first fund created 49 in section 8.57A for cost sharing to match the United 50 -6- HF2458.4103.S (2) 85 jh 6/ 21

PERSONNEL SETTLEMENT AGREEMENT 36 PAYMENTS. As a condition made to any appropriation to 37 the department of agriculture and land stewardship, 38 the department of natural resources, or Iowa state 39 university as provided in this Act, moneys appropriated 40 and any other moneys available for use by the entity 41 receiving the appropriation under this Act shall not 42 be used for the payment of a personnel settlement 43 agreement between that entity and a state employee 44 that contains a confidentiality provision intended to 45 prevent public disclosure of the agreement or any terms 46 of the agreement. 47 DIVISION IX 48 DNR —— AIR QUALITY PROGRAM TASK FORCE 49 Sec. 26. AIR QUALITY PROGRAM TASK FORCE. 50 -16- HF2458.4103.S (2) 85 jh 16/ 21
1. As used in this section: 1 a. “Bureau” means the air quality bureau of the 2 department of natural resources. 3 b. “Commission” means the environmental protection 4 commission. 5 c. “Department” means the department of natural 6 resources. 7 d. “Director” means the director of the department. 8 2. An air quality program task force is created 9 within the department. 10 3. The membership of the task force shall include 11 voting members appointed as follows: 12 a. Nine individuals representing interested 13 organizations as appointed by the governing body of 14 each organization. The interested organizations shall 15 include all of the following: 16 (1) The Iowa utility association. 17 (2) The Iowa association of municipal utilities. 18 (3) The Iowa limestone producers association. 19 (4) The asphalt paving association of Iowa. 20 (5) The Iowa environmental council. 21 (6) The Iowa association of electric cooperatives. 22 (7) The Iowa chapter of the national federation of 23 independent business. 24 (8) The Iowa institute for cooperatives. 25 (9) The agribusiness association of Iowa. 26 b. At least two individuals each representing a 27 private facility as determined by the department. The 28 director shall appoint the individuals. The private 29 facilities shall include all of the following: 30 (1) One that currently pays fees under Title V of 31 the federal Clean Air Act Amendments of 1990, 42 U.S.C. 32 §7401 et seq., pursuant to chapter 455B, including 567 33 IAC ch. 22. 34 (2) One that has been issued a construction permit 35 pursuant to chapter 455B for minor emissions of air 36 contaminants, if the facility is not required to pay 37 fees as provided in subparagraph (1). 38 c. Any other individuals representing persons 39 specified by the department who shall be appointed by 40 the director, including but not limited to additional 41 individuals representing different private facilities 42 as provided in paragraph “b”. The director shall make 43 every effort possible to provide for gender balanced 44 appointments. 45 4. The membership of the task force shall include 46 three nonvoting members appointed as follows: 47 a. One individual representing the department who 48 shall be appointed by the director. 49 b. One individual representing the commission who 50 -17- HF2458.4103.S (2) 85 jh 17/ 21
shall be appointed by the commission. 1 c. One member representing the Iowa association of 2 business and industry who shall be appointed by the 3 governing body of that association. 4 5. a. The department shall provide office space, 5 staff assistance, and necessary supplies and equipment 6 to the task force. 7 b. To every extent feasible, the department shall 8 nominate and the task force shall vote to approve a 9 qualified person to facilitate the conduct of the 10 meetings in a neutral manner that promotes considered 11 and effective deliberation and consensus. The person 12 shall serve without receiving compensation or expenses. 13 c. A vacancy in the membership of the task force 14 does not impair the right of a quorum to exercise all 15 rights and perform all duties of the task force. 16 d. A majority of voting members of the task force 17 constitutes a quorum. Any action taken by the task 18 force must be adopted by the affirmative vote of a 19 majority of its members present, except that a lesser 20 number may adjourn a meeting. 21 6. a. The task force shall do all of the 22 following: 23 (1) Examine the current status of air quality 24 programs, including associated permits and fees 25 or other funding mechanisms, administered by the 26 department’s air quality bureau. 27 (2) Review resources available to the bureau 28 including but not limited to its full-time and 29 part-time employees and permit processing times with 30 the goal of identifying efficiencies that can be 31 made internally by the bureau to better streamline 32 the permit process for the bureau, permittees, and 33 taxpayers. 34 (3) Consider the future economic impact to 35 consumers, businesses, and taxpayers resulting in all 36 of the following: 37 (a) Maintaining the current fee structure. 38 (b) Establishing, implementing, and administering 39 a new fee structure. 40 (4) Consider the possible need for the 41 establishment of alternative funding mechanisms to 42 support the bureau including a new fee structure and 43 revenue formula to be administered by the bureau. 44 b. The task force may review similar air quality 45 programs and fee structures administered in other 46 states which may be used to identify a national, 47 regional, or other identifiable average of costs for 48 administering such programs. 49 7. a. The task force shall approve a report 50 -18- HF2458.4103.S (2) 85 jh 18/ 21
prepared by the department of natural resources. 1 b. The report shall include findings and 2 recommendations adopted by the task force. 3 c. The department shall submit the report to the 4 governor, the director, the environmental protection 5 commission, and the general assembly not later than 6 December 15, 2014. 7 8. This section is repealed on December 16, 2014. 8 Sec. 27. EFFECTIVE UPON ENACTMENT. This division 9 of this Act, being deemed of immediate importance, 10 takes effect upon enactment. 11 DIVISION X 12 RECREATIONAL LAKE AND WATER QUALITY DISTRICTS 13 Sec. 28. NEW SECTION . 357E.15 Exemption from 14 taxation —— refunds. 15 1. The property and facilities of a district shall 16 not be taxable in any manner by the state or any of its 17 political subdivisions. 18 2. A district is a tax-certifying body for purposes 19 of section 423.4, subsection 1. 20 Sec. 29. Section 427.1, subsection 2, Code 2014, is 21 amended to read as follows: 22 2. Municipal and military property. The property 23 of a county, township, city, school corporation, levee 24 district, drainage district, district organized under 25 chapter 357E, or the Iowa national guard, when devoted 26 to public use and not held for pecuniary profit, except 27 property of a municipally owned electric utility held 28 under joint ownership and property of an electric 29 power facility financed under chapter 28F or 476A that 30 shall be subject to taxation under chapter 437A and 31 facilities of a municipal utility that are used for 32 the provision of local exchange services pursuant to 33 chapter 476 , but only to the extent such facilities 34 are used to provide such services, which shall be 35 subject to taxation under chapter 433 , except that 36 section 433.11 shall not apply. The exemption for 37 property owned by a city or county also applies to 38 property which is operated by a city or county as a 39 library, art gallery or museum, conservatory, botanical 40 garden or display, observatory or science museum, or 41 as a location for holding athletic contests, sports 42 or entertainment events, expositions, meetings or 43 conventions, or leased from the city or county for 44 any such purposes, or leased from the city or county 45 by the Iowa national guard or by a federal agency for 46 the benefit of the Iowa national guard when devoted 47 for public use and not for pecuniary profit. Food and 48 beverages may be served at the events or locations 49 without affecting the exemptions, provided the city 50 -19- HF2458.4103.S (2) 85 jh 19/ 21
has approved the serving of food and beverages on the 1 property if the property is owned by the city or the 2 county has approved the serving of food and beverages 3 on the property if the property is owned by the 4 county. The exemption for property owned by a city or 5 county also applies to property which is located at an 6 airport and leased to a fixed base operator providing 7 aeronautical services to the public. 8 Sec. 30. IMPLEMENTATION OF ACT. Section 25B.7 does 9 not apply to the property tax exemption established in 10 this division of this Act. 11 Sec. 31. EFFECTIVE UPON ENACTMENT. This division 12 of this Act, being deemed of immediate importance, 13 takes effect upon enactment. 14 Sec. 32. RETROACTIVE APPLICABILITY. This division 15 of this Act applies retroactively to January 1, 2014, 16 for property tax assessment years beginning on or after 17 that date. 18 Sec. 33. RETROACTIVE APPLICABILITY. This division 19 of this Act applies retroactively to January 1, 2014, 20 for sales and use tax paid on or after that date. 21 DIVISION XI 22 RELATED STATUTORY CHANGES FOR CODIFICATION IN 2014 23 WATER QUALITY INITIATIVE —— CONFIDENTIALITY 24 Sec. 34. NEW SECTION . 466B.49 Confidentiality of 25 information. 26 Any information received, collected, or held under 27 this subchapter is a confidential record, and is 28 exempted from public access as provided in section 29 22.7, if all of the following apply: 30 1. The information is received, collected, or held 31 by a nonprofit organization that conducts nutrient 32 management research, including but not limited to 33 conducting evaluations, assessments, or validations. 34 2. The information identifies any of the following: 35 a. A person who holds a legal interest in 36 agricultural land or who has previously held a legal 37 interest in agricultural land. 38 b. A person who is involved or who has previously 39 been involved in managing the agricultural land or 40 producing crops or livestock on the agricultural land. 41 c. The identifiable location of the agricultural 42 land. 43 Sec. 35. EFFECTIVE UPON ENACTMENT. This division 44 of this Act, being deemed of immediate importance, 45 takes effect upon enactment. 46 DIVISION XII 47 REPEAL 48 Sec. 36.
