Page 37, after line 13 by inserting: 3 < DIVISION ___ 4 STATEWIDE PRESCHOOL PROGRAM PROVISIONS 5 Sec. ___. Section 256C.3, subsection 3, paragraph 6 h, Code 2014, is amended to read as follows: 7 h. Provision for ensuring that children receiving 8 care from other child care arrangements can participate 9 in the preschool program with minimal disruption due to 10 transportation and movement from one site to another. 11 The children participating in the preschool program may 12 be transported by the school district to activities 13 associated with the program along with other children. 14 Sec. ___. Section 256C.3, subsection 3, Code 2014, 15 is amended by adding the following new paragraph: 16 NEW PARAGRAPH . i. A requirement that children 17 with a family income at or below one hundred thirty 18 percent of the federal poverty level, as defined by 19 the most recently revised poverty income guidelines 20 published by the United States department of health 21 and human services, shall not be subject to additional 22 tuition, fees, or other charges for added preschool 23 time or other preschool-related services provided in 24 addition to the minimum hours of instruction provided 25 in accordance with paragraph “f” . 26 Sec. ___. Section 256C.3, subsection 4, Code 2014, 27 is amended by adding the following new paragraph: 28 NEW PARAGRAPH . e. Development and implementation 29 of a plan for the school district’s preschool program 30 to have sufficient capacity to operate without a 31 waiting list for school budget years beginning on or 32 after July 1, 2017. 33 Sec. ___. Section 256C.4, subsection 1, paragraphs 34 g and h, Code 2014, are amended to read as follows: 35 g. For the fiscal year beginning July 1, 2011 36 2014 , and each succeeding fiscal year, of the amount 37 of preschool foundation aid received by a school 38 district for a fiscal year in accordance with section 39 257.16 , not more than five percent may be used by 40 the school district for administering the district’s 41 approved local program. Outreach activities and rent 42 for facilities not owned by the school district are 43 permissive uses of the administrative funds. 44 h. For the fiscal year beginning July 1, 2012 2014 , 45 and each succeeding fiscal year, of the amount of 46 preschool foundation aid received by a school district 47 for a fiscal year in accordance with section 257.16 , 48 not less than ninety-five percent of the per pupil 49 amount shall be passed through to a community-based 50 -1- SF2347.4034 (2) 85 kh/tm 1/ 7 #1.
provider for each pupil enrolled in the district’s 1 approved local program. For the fiscal year beginning 2 July 1, 2011 2014 , and each succeeding fiscal year, not 3 more than five ten percent of the amount of preschool 4 foundation aid passed through to a community-based 5 provider may be used by the community-based provider 6 for administrative costs. The costs of outreach 7 activities and rent for facilities not owned by 8 the school district are permissive administrative 9 costs. The costs of transportation involving children 10 participating in the preschool program and other 11 children may be prorated. 12 Sec. ___. Section 256C.4, subsection 2, paragraph 13 b, Code 2014, is amended to read as follows: 14 b. The enrollment count of eligible students shall 15 not include a child who is included in the enrollment 16 count determined under section 257.6 or a child who 17 is served by a an existing preschool program already 18 receiving state or federal funds for the purpose of 19 the provision of providing four-year-old preschool 20 programming while the child is being served by the 21 existing program. Such preschool programming However, 22 the enrollment count of eligible students may include 23 a child being served by an existing preschool program 24 if the preschool programming in the existing program 25 has been enhanced as a result of preschool program 26 expansion incentive state aid provided under section 27 256C.7. For the purposes of this chapter an “existing 28 preschool program” includes but is not limited to 29 shared visions and other child development assistance 30 programs provided under chapter 256A and section 31 279.51 , special education programs provided under 32 section 256B.9 , school ready children grant programs 33 and other programs provided under chapter 256I , and 34 federal head start programs and the services funded 35 by Tit. I of the federal Elementary and Secondary 36 Education Act of 1965. 37 Sec. ___. Section 256C.5, subsection 1, unnumbered 38 paragraph 1, Code 2014, is amended to read as follows: 39 For the purposes of this section and section 256C.4 40 chapter, unless the context otherwise requires : 41 Sec. ___. NEW SECTION . 256C.7 Preschool program 42 expansion incentive. 43 1. For the purposes of this section, unless the 44 context otherwise requires: 45 a. “Base incentive enrollment” means the average 46 of the actual enrollments of eligible students in the 47 preschool programming provided by a school district on 48 October 1, 2011, October 1, 2012, and October 1, 2013. 49 b. “Incentive period” means the budget years 50 -2- SF2347.4034 (2) 85 kh/tm 2/ 7
beginning July 1, 2015, July 1, 2016, and July 1, 2017. 1 c. “Incentive enrollment” means the amount by which 2 the actual enrollment of eligible students in the 3 preschool programming provided by a school district 4 on October 1 of the base year exceeds the school 5 district’s base incentive enrollment. 6 d. “Incentive state aid” means the product of twenty 7 percent of the regular program state cost per pupil for 8 the budget year multiplied by the school district’s 9 incentive enrollment in the base year. 10 2. a. A preschool program expansion incentive 11 is established in accordance with this section. In 12 order to be eligible for the incentive, a school 13 district must develop and implement a preschool 14 program expansion plan, approved by the department, to 15 expand enrollment of eligible students in the school 16 district’s preschool programming. In addition, the 17 school district shall work with existing preschool 18 program providers to expand hours and otherwise enhance 19 the preschool programming available to the children 20 participating in the programs. The plan’s goal 21 shall be that by the end of the incentive period the 22 district’s preschool programming will be available 23 without a waiting list to each child wanting to enroll 24 in the programming. After completion of the incentive 25 period, the department shall analyze the growth in 26 access to the preschool program and enhancements made 27 in preschool programming as a result of the incentive, 28 including in the programs provided directly by school 29 districts and in those offered in partnership with 30 community providers. The department shall submit 31 a report to the general assembly that shall include 32 identification of progress made toward the incentive 33 program’s goals and documentation of collaboration 34 efforts made with input from participating families, 35 early care providers, and community partners. 36 b. The elements addressed in the preschool program 37 expansion plan shall include but are not limited to the 38 following: 39 (1) How the school district will work in 40 collaboration with participating families, early care 41 providers, and community partners, as described in 42 section 256C.3, subsection 3, to provide the preschool 43 programming in as convenient and cost-effective 44 a manner as possible for the families of the 45 four-year-old children who are eligible for the 46 programming. 47 (2) A specification of the roles of the early care 48 providers and community partners in support of the 49 expansion plan. 50 -3- SF2347.4034 (2) 85 kh/tm 3/ 7
(3) A delineation of the specific steps for 1 expanding hours and otherwise enhancing the preschool 2 programming available to the children participating in 3 the existing preschool programs located in the school 4 district. 5 (4) Identification of specific outcomes and 6 progress measures for the expansion plan. 7 (5) Detailed plans for contacting and soliciting 8 enrollment of eligible students, particularly from 9 low-income families, non-English speaking families, and 10 families from ethnic and racial groups underrepresented 11 in the district’s preschool program enrollment. 12 3. The department of education shall provide 13 required elements and recommend best practices for 14 outreach and program expansion under the incentive, 15 including expansion plan models that school districts 16 may consider in developing their local expansion plans, 17 and including but not limited to submission provisions, 18 annual updates, and documentation of collaboration 19 efforts with and input from participating families, 20 early care providers, and community partners. 21 4. During the incentive period, in addition to the 22 regular preschool foundation aid based on the preschool 23 budget enrollment, the school district implementing a 24 preschool expansion plan approved by the department 25 shall receive incentive state aid based on the 26 district’s incentive enrollment. The incentive state 27 aid shall be paid as part of the state aid payments 28 made to school districts in accordance with section 29 257.16. 30 5. A school district shall utilize its incentive 31 state aid to defray increases in costs in connection 32 with the school district’s preschool program expansion 33 plan. Such costs shall include but are not limited 34 to renovation and other facility costs connected with 35 expansion, outreach, one-time expenses, and other costs 36 identified as eligible by the department. 37 Sec. ___. Section 257.16, Code 2014, is amended by 38 adding the following new subsection: 39 NEW SUBSECTION . 1A. For the fiscal years in which 40 the preschool program expansion incentive applies in 41 accordance with section 256C.7, the appropriation made 42 in subsection 1 shall include the amount necessary to 43 pay incentive state aid in accordance with section 44 256C.7. This subsection is repealed on July 1, 2018. 45 Sec. ___. STATE MANDATE FUNDING SPECIFIED. In 46 accordance with section 25B.2, subsection 3, the state 47 cost of requiring compliance with any state mandate 48 included in this division of this Act shall be paid 49 by a school district from state school foundation 50 -4- SF2347.4034 (2) 85 kh/tm 4/ 7
aid received by the school district under section 1 257.16. This specification of the payment of the 2 state cost shall be deemed to meet all of the state 3 funding-related requirements of section 25B.2, 4 subsection 3, and no additional state funding shall be 5 necessary for the full implementation of this division 6 of this Act by and enforcement of this division of this 7 Act against all affected school districts. > 8 2.
