Section 484C.2, subsection 2, Code 2014, 6 is amended to read as follows: 7 2. This chapter authorizes the department of 8 natural resources to regulate preserve whitetail and 9 land associated with hunting preserves . However, 10 the department of agriculture and land stewardship 11 shall regulate whitetail kept as farm deer pursuant to 12 chapter 170 . 13 Sec. ___. Section 484C.4, Code 2014, is amended to 14 read as follows: 15 484C.4 Departmental programs and requirements. 16 The department shall develop, administer, and 17 enforce hunting preserve programs and requirements, 18 which implement the provisions of this chapter and 19 rules adopted by the department pursuant to section 20 484C.3 , regarding fencing, recordkeeping, reporting, 21 and the tagging, and transportation , ; the testing, and 22 monitoring , and quarantining for disease of preserve 23 whitetail ; and the quarantining of a hunting preserve 24 or a former hunting preserve where diseased preserve 25 whitetail are or were kept . 26 Sec. ___. Section 484C.12, Code 2014, is amended by 27 adding the following new subsection: 28 NEW SUBSECTION . 3. The department may quarantine 29 a hunting preserve or former hunting preserve if 30 it determines that the presence of an infectious, 31 contagious, or reportable disease threatens the health 32 of animal populations. A landowner of the hunting 33 preserve or former hunting preserve shall comply with 34 all requirements of the quarantine. The quarantine 35 shall provide for the maintenance of a fence in the 36 same manner as required in section 484C.6, regardless 37 of any of the following: 38 a. The fence has not been certified or is no longer 39 certified under section 484C.6 or the hunting preserve 40 has not been registered or is no longer registered 41 pursuant to section 484C.7. 42 b. The landowner has relinquished the hunting 43 preserve as part of a business, including but not 44 limited to by removing any number of whitetail. > 45 2.
