accident
involving
death.

1.
Notwithstanding
any
other
provision
of
this
6
chapter
to
the
contrary,
a
person
who
operates
a
motor
7
vehicle
who
is
involved
in
a
motor
vehicle
accident
or
8
collision
resulting
in
death
shall
submit
to
a
chemical
9
test
of
the
person’s
blood
to
determine
the
alcohol
10
concentration
or
the
presence
of
a
controlled
substance
11
or
other
drugs.
The
investigating
peace
officer
shall
12
cause
a
test
to
be
administered
as
soon
as
practicable
13
following
the
accident
in
the
same
manner
as
prescribed
14
in
section
321J.11.

2.
The
result
of
the
test
is
admissible
at
trial
if
16
the
court,
after
reviewing
all
the
evidence,
whether
17
gathered
prior
to,
during,
or
after
the
test,
is
18
satisfied
that
probable
cause
exists,
independent
of
19
the
test
result,
to
believe
that
the
driver
of
the
20
motor
vehicle
was
under
the
influence
of
an
alcoholic
21
beverage
or
other
drug
or
a
combination
of
such
22
substances
at
the
time
of
the
accident.

3.
If
a
person
fails
to
submit
to
a
test
under
24
this
section
the
department
shall
revoke
the
person’s
25
driver’s
license
or
any
nonresident
operating
privilege
26
as
required
by
and
for
the
applicable
period
specified

under
section
321J.9.
