(1) The department may, on application, 21 issue a temporary restricted license to a person whose 22 noncommercial driver’s license is revoked under this 23 chapter allowing the person to drive for any lawful 24 purpose if the person’s driver’s license has not been 25 revoked previously under section 321J.4, 321J.9, or 26 321J.12. 27 (2) The department may, on application, issue 28 a temporary restricted license to a person whose 29 noncommercial driver’s license is revoked under this 30 chapter allowing the person to drive to and from the 31 person’s home and specified places at specified times 32 which can be verified by the department and which 33 are required by the person’s full-time or part-time 34 employment, continuing health care or the continuing 35 health care of another who is dependent upon the 36 person, continuing education while enrolled in an 37 educational institution on a part-time or full-time 38 basis and while pursuing a course of study leading to a 39 diploma, degree, or other certification of successful 40 educational completion, substance abuse treatment, 41 court-ordered community service responsibilities, and 42 appointments with the person’s parole or probation 43 officer if the person’s driver’s license has not been 44 revoked previously under section 321J.4 , 321J.9 , or 45 321J.12 and if any of the following apply: 46 (1) (a) The person’s noncommercial driver’s 47 license is revoked under section 321J.4 and the minimum 48 period of ineligibility for issuance of a temporary 49 restricted license has expired. shall not apply to a revocation ordered under section 1 321J.4 resulting from a plea or verdict of guilty 2 of a violation of section 321J.2 that involved a 3 death except for a revocation under section 321J.4, 4 subsection 1, paragraph “c” or “e” . 5 (2) (b) The person’s noncommercial driver’s 6 license is revoked under section 321J.9 and the person 7 has entered a plea of guilty on a charge of a violation 8 of section 321J.2 which arose from the same set of 9 circumstances which resulted in the person’s driver’s 10 license revocation under section 321J.9 and the 11 guilty plea is not withdrawn at the time of or after 12 application for the temporary restricted license, and 13 the minimum period of ineligibility for issuance of a 14 temporary restricted license has expired. 15 (3) (c) The person’s noncommercial driver’s 16 license is revoked under section 321J.12 , and the 17 minimum period of ineligibility for issuance of a 18 temporary restricted license has expired . 19 b. A temporary restricted license may be issued 20 under this subsection if the person’s noncommercial 21 driver’s license is revoked for two years under section 22 321J.4, subsection 2 , or section 321J.9, subsection 1 , 23 paragraph “b” , and the first three hundred sixty-five 24 days of the revocation have expired. > 25 5.
