The general 5 assembly finds and declares all of the following: 6 1. This state and the United States have 7 demonstrated a commitment to a long term policy of 8 increasing the production, distribution, and use 9 of clean renewable fuels according to a renewable 10 fuel standard, sometimes referred to as “RFS2”, by 11 encouraging the increased domestic production and 12 utilization of renewable fuels, which includes total 13 renewable biofuels such as ethanol, advanced biofuels, 14 cellulosic and agricultural waste-based biofuels, and 15 biomass-based biodiesel. 16 2. Renewable fuels have become increasingly 17 important to this state and its economy including by 18 providing jobs and strengthening rural communities, and 19 have proven to be economically viable for consumers in 20 this state and throughout the midwest. > 21 2. Section 323.1, Code 2013, is amended by 27 adding the following new subsections: 28 NEW SUBSECTION . 01. “Blender pump” means a motor 29 fuel blender pump as defined in section 214.1 that 30 dispenses motor fuel or special fuel in a manner 31 required pursuant to chapters 214 and 214A. 32 NEW SUBSECTION . 7A. “Motor fuel pump” means the 33 same as defined in section 214.1 that dispenses motor 34 fuel or special fuel in a manner that complies with 35 standards set forth in chapters 214 and 214A. 36 NEW SUBSECTION . 7B. “Refiner” means a person 37 engaged in the refining of crude oil to produce motor 38 fuel or special fuel, and includes any affiliate of 39 such person. 40 NEW SUBSECTION . 7C. “Renewable fuel” means the 41 same as defined in section 214A.1 that complies with 42 standards set forth in section 214A.2. 43 NEW SUBSECTION . 11. “Storage tank” means a 44 motor fuel storage tank as defined in section 214.1, 45 including an underground storage tank subject to 46 regulation under chapter 455G. 47 NEW SUBSECTION . 12. “Supplier” means the same as 48 defined in section 452A.2. 49 Sec. ___. A supply agreement or other document executed by 2 a distributor or dealer and a refiner or supplier on or 3 after the effective date of this Act shall not contain 4 a provision restricting the distributor or dealer from 5 doing any of the following: 6 a. Installing, converting, or operating a storage 7 tank, a motor fuel pump, or a blender pump located on 8 the distributor’s or dealer’s retail premises for use 9 in storing or dispensing renewable fuel. However, 10 this paragraph does not apply to a dealer whose retail 11 premises are leased from the distributor or franchiser. 12 b. Using a motor fuel pump to dispense ethanol 13 blended gasoline, including gasoline with a specified 14 blend or a range of blends under chapter 214A, if 15 the motor fuel pump meets all applicable federal and 16 state requirements and is approved as required by the 17 state fire marshal for dispensing the specified blend 18 or range of blends, including as provided in section 19 455G.31. 20 c. Purchasing, selling, or dispensing motor fuel 21 or special fuel that is a renewable fuel from a source 22 other than the refiner or supplier if the refiner or 23 supplier does not provide motor fuel or special fuel 24 that is a renewable fuel for sale by the distributor 25 or dealer. 26 2. This section does not apply to any activity 27 that constitutes mislabeling, misbranding, willful 28 adulteration, or other trademark violation by the 29 dealer. > 30 5.
