1.
Each
newborn
born
in
this
state
shall
receive
9
a
critical
congenital
heart
disease
screening
by
10
pulse
oximetry
or
other
means
as
determined
by
rule,
11
in
conjunction
with
the
metabolic
screening
required
12
pursuant
to
section
136A.5.
13
2.
An
attending
health
care
provider
shall
ensure
14
that
every
newborn
under
the
provider’s
care
receives
15
the
critical
congenital
heart
disease
screening.
16
3.
This
section
does
not
apply
if
a
parent
objects
17
to
the
screening.
If
a
parent
objects
to
the
screening
18
of
a
newborn,
the
attending
health
care
provider
shall
19
document
the
refusal
in
the
newborn’s
medical
record
20
and
shall
obtain
a
written
refusal
from
the
parent
and
21
report
the
refusal
to
the
department.

4.
Notwithstanding
any
provision
to
the
contrary,
23
the
results
of
each
newborn’s
critical
congenital
24
heart
disease
screening
shall
only
be
reported
in
a
25
manner
consistent
with
the
reporting
of
the
results
26
of
metabolic
screenings
pursuant
to
section
136A.5

if
funding
is
available
for
implementation
of
the
28
reporting
requirement.

5.
This
section
shall
be
administered
in
accordance
30
with
rules
adopted
pursuant
to
section
136A.8.

Sec.

NEWBORN
CRITICAL
CONGENITAL
HEART

DISEASE
SCREENING.
Notwithstanding
any
provision
33
to
the
contrary
relating
to
the
newborn
screening
34
policy
pursuant
to
641
IAC
4.3(1),
critical
congenital
35
heart
disease
screening
shall
be
included
in
the
36
state’s
newborn
screening
panel
as
included
in
the
37
recommended
uniform
screening
panel
as
approved
by
the
38
United
States
secretary
of
health
and
human
services.
39
The
center
for
congenital
and
inherited
disorders
40
advisory
committee
shall
make
recommendations
regarding
41
implementation
of
the
screening
and
the
center
for
42
congenital
and
inherited
disorders
shall
adopt
rules
43
as
necessary
to
implement
the
screening.
However,
44
reporting
of
the
results
of
each
newborn’s
critical
45
congenital
heart
disease
screening
shall
not
be
46
required
unless
funding
is
available
for
implementation
47
of
the
reporting
requirement.
