NEW SECTION . 232.101A Transfer of 4 guardianship of child to custodian. 5 1. After a dispositional hearing the court may 6 enter an order transferring guardianship of the child 7 to a custodian if all of the following conditions are 8 met: 9 a. The person receiving guardianship meets the 10 definition of custodian under section 232.2, subsection 11 11. 12 b. The person receiving guardianship has assumed 13 responsibility for the child for at least the six 14 consecutive months prior to filing of the petition 15 under this division and has maintained placement of 16 the child since the filing of the petition under this 17 division. 18 c. The parent of the child does not appear at the 19 dispositional hearing, or the parent appears at the 20 dispositional hearing, does not object to the transfer 21 of guardianship, and agrees to waive the requirement 22 for making reasonable efforts. 23 2. If the court transfers guardianship pursuant to 24 subsection 1, the court may close the child in need of 25 assistance case by transferring jurisdiction over the 26 child’s guardianship to the probate court. The court 27 shall inform the proposed guardian of the guardian’s 28 reporting duties under section 633.669 and other duties 29 under chapter 633. Upon transferring jurisdiction, the 30 court shall direct the probate clerk, once the proposed 31 guardian has filed an oath of office and identification 32 in accordance with section 602.6111, to issue letters 33 of appointment for guardianship and docket the case in 34 probate. Records contained in the probate case file 35 that were copied or transferred from the juvenile court 36 file concerning the case shall be subject to section 37 232.147 and other confidentiality provisions of this 38 chapter for cases not involving juvenile delinquency. > 39 2.
