Except when Whether or not a child has been 5 enrolled in a public school district under section 6 299A.8 , the director of the department of education, 7 or the director’s designee, which may include a school 8 district or an area education agency, shall administer 9 the annual achievement evaluation at no cost to the 10 parent, guardian, or legal custodian of the child 11 being evaluated shall reimburse the entity conducting 12 the evaluation for no more than the actual cost of 13 evaluation required by this chapter . However , and the 14 parent, guardian, or legal custodian is not required to 15 reimburse the evaluating entity for costs incurred as a 16 result of evaluation under section 299A.9 . 17 Sec. ___. Section 299A.8, Code 2013, is amended to 18 read as follows: 19 299A.8 Dual enrollment. 20 1. If a parent, guardian, or legal custodian of 21 a school-age child who is receiving competent private 22 instruction under this chapter submits a request, the 23 child shall also be registered in a public school for 24 dual enrollment purposes. If the child is enrolled in 25 a public school district for dual enrollment purposes, 26 the child shall be permitted to participate in any 27 academic activities in the district and shall also be 28 permitted to participate on the same basis as public 29 school children in any extracurricular activities 30 available to children in the child’s grade or group , 31 and the parent, guardian, or legal custodian shall not 32 be required to pay the costs of any annual evaluation 33 under this chapter . Dual enrollment of a child solely 34 for purposes of accessing the annual achievement 35 evaluation shall not constitute a dual enrollment 36 purpose. 37 2. If the child is enrolled for dual enrollment 38 purposes, the child shall be included in the public 39 school’s basic enrollment under section 257.6 . A pupil 40 who is participating only in extracurricular activities 41 shall be counted under section 257.6, subsection 1 , 42 paragraph “a” , subparagraph (6). A pupil enrolled in 43 grades nine through twelve under this section shall 44 be counted in the same manner as a shared-time pupil 45 under section 257.6, subsection 1 , paragraph “a” , 46 subparagraph (3). > 47 2.
