Beginning January 1, 2014, in 5 accordance with section 1902(a)(10)(A)(i)(VIII) of the 6 federal Social Security Act, as codified in 42 U.S.C. 7 § 1396a(a)(10)(A)(i)(VIII), is an individual who is 8 nineteen years of age or older and under sixty-five 9 years of age; is not pregnant; is not entitled to 10 or enrolled for Medicare benefits under part A, or 11 enrolled for Medicare benefits under part B, of Tit. 12 XVIII of the federal Social Security Act; is not 13 otherwise described in section 1902(a)(10)(A)(i) of the 14 federal Social Security Act; is not exempt pursuant 15 to section 1902(k)(3), as codified in 42 U.S.C. § 16 1396a(k)(3), and whose income as determined under 17 1902(e)(14) of the federal Social Security Act, as 18 codified in 42 U.S.C. § 1396a(e)(14), does not exceed 19 one hundred thirty-three percent of the poverty line 20 as defined in section 2110(c)(5) of the federal Social 21 Security Act, as codified in 42 U.S.C. § 1397jj(c)(5), 22 for the applicable family size. Notwithstanding 23 any provision to the contrary, individuals eligible 24 for medical assistance under this paragraph shall 25 receive coverage for benefits pursuant to 42 U.S.C. 26 § 1396u-7(b)(1)(D) which are at a minimum those 27 included in the medical assistance state plan benefit 28 package for individuals otherwise eligible under this 29 subsection 1, and adjusted as necessary to provide 30 the essential health benefits as required pursuant 31 to section 1302 of the federal Patient Protection 32 and Affordable Care Act, Pub. L. No. 111-148, and as 33 approved by the United States secretary of health and 34 human services. > 35 3. Page 6, after line 23 by inserting: 36 < Sec. ___. MEDICAID STATE PLAN. 37 1. The department of human services shall amend the 38 medical assistance state plan to provide for coverage 39 of adults up to 133 percent of the federal poverty 40 level as provided in this Act beginning January 1, 41 2014. 42 2.
