Code
2013,
is
amended
by

adding
the
following
new
subsection:

NEW
SUBSECTION
.
16.
a.
Notwithstanding
7
subsections
1
through
12,
a
nonpublic
school
may
be
8
accredited
by
an
approved
independent
accrediting
9
agency
instead
of
by
the
state
board
as
provided
in
10
this
subsection.
The
state
board
shall
maintain
a
list
11
of
approved
independent
accrediting
agencies
comprised
12
of
at
least
six
regional
or
national
nonprofit,
13
nongovernmental
agencies
recognized
as
reliable
14
authorities
concerning
the
quality
of
education
offered
15
by
a
school
and
shall
publish
the
list
of
independent
16
accrediting
agencies
on
the
department’s
internet
site.
17
The
list
shall
include
accrediting
agencies
that,
as
18
of
January
1,
2013,
accredited
a
nonpublic
school
in
19
this
state
that
was
concurrently
accredited
under
20
this
section;
and
any
agency
that
has
a
formalized
21
partnership
agreement
with
another
agency
on
the
list
22
and
has
member
schools
in
this
state
as
of
January
1,
23
2013.
24
b.
A
nonpublic
school
that
participates
in
the
25
accreditation
process
offered
by
an
independent
26
accrediting
agency
on
the
approved
list
published
27
pursuant
to
paragraph
“a”
shall
be
deemed
to
meet
the
28
education
standards
of
this
section.
However,
such
a
29
school
shall
comply
with
statutory
health
and
safety
30
requirements
for
school
facilities.
31
c.
If
the
state
board
takes
preliminary
action
to
32
remove
an
agency
from
the
approved
list
published
on
33
the
department’s
internet
site
pursuant
to
paragraph
34
“a”
,
the
department
shall,
at
least
one
year
prior
to
35
removing
the
agency
from
the
approved
list,
notify
the
36
nonpublic
schools
participating
in
the
accreditation
37
process
offered
by
the
agency
of
the
state
board’s
38
intent
to
remove
the
accrediting
agency
from
its
39
approved
list
of
independent
accrediting
agencies.
40
The
notice
shall
also
be
posted
on
the
department’s
41
internet
site
and
shall
contain
the
proposed
date
42
of
removal.
The
nonpublic
school
shall
attain
43
accreditation
under
this
subsection
or
subsections
1
44
through
12
not
later
than
one
year
following
the
date
45
on
which
the
state
board
removes
the
agency
from
its
46
list
of
independent
accrediting
agencies.

Teaching
parent.
As
an
alternative
to
the
2
driver
education
requirements
under
section
321.178,
3
a
teaching
parent
may
instruct
a
student
in
a
driver
4
education
course
that
meets
the
requirements
of
this
5
section
and
provide
evidence
that
the
requirements
6
under
this
section
have
been
met.
7
2.
Definitions.
For
purposes
of
this
section:
8
a.
“Approved
course”
means
driver
education
9
curriculum
approved
by
the
department
pursuant
to
rules
10
adopted
under
chapter
17A.
An
approved
course
shall,
11
at
a
minimum,
meet
the
requirements
of
subsection
3
12
and
be
appropriate
for
teaching-parent-directed
driver
13
education
and
related
street
or
highway
instruction.
14
Driver
education
materials
that
meet
or
exceed
15
standards
established
by
the
department
for
an
approved
16
course
in
driver
education
for
a
public
or
private
17
school
shall
be
approved
unless
otherwise
determined
by
18
the
department.
The
list
of
approved
courses
shall
be
19
posted
on
the
department’s
internet
site.
20
b.
“Student”
means
a
person
between
the
ages
of
21
fourteen
and
twenty-one
years
who
is
within
the
custody
22
and
control
of
the
teaching
parent
and
who
satisfies
23
preliminary
licensing
requirements
of
the
department.
24
c.
“Teaching
parent”
means
a
parent,
guardian,
25
or
legal
custodian
of
a
student
who
is
currently
26
providing
competent
private
instruction
to
the
student
27
pursuant
to
section
299A.2
or
299A.3
and
who
provided
28
such
instruction
to
the
student
during
the
previous
29
year;
who
has
a
valid
driver’s
license,
other
than
a
30
motorized
bicycle
license
or
a
temporary
restricted
31
license,
that
permits
unaccompanied
driving;
and
32
who
has
maintained
a
clear
driving
record
for
the
33
previous
two
years.
For
purposes
of
this
paragraph,
34
“clear
driving
record”
means
the
individual
has
not
35
been
identified
as
a
candidate
for
suspension
or
36
revocation
of
a
driver’s
license
under
the
habitual
37
violator
or
habitual
offender
provisions
of
the
38
department’s
regulations;
is
not
subject
to
a
driver’s
39
license
suspension,
revocation,
denial,
cancellation,
40
disqualification,
or
bar;
and
has
no
record
of
a
41
conviction
for
a
moving
traffic
violation
determined
to
42
be
the
cause
of
a
motor
vehicle
accident.
43
3.
Course
of
instruction.
44
a.
An
approved
course
administered
by
a
teaching
45
parent
shall
consist
of
but
not
be
limited
to
the
46
following:
47
(1)
Thirty
clock
hours
of
classroom
instruction.
48
(2)
Forty
hours
of
street
or
highway
driving
49
including
four
hours
of
driving
after
sunset
and
before

sunrise
while
accompanied
by
the
teaching
parent.

(3)
Four
hours
of
classroom
instruction
concerning
2
substance
abuse.

(4)
A
minimum
of
twenty
minutes
of
instruction

concerning
railroad
crossing
safety.

(5)
Instruction
relating
to
becoming
an
organ
6
donor
under
the
revised
uniform
anatomical
gift
Act
as
7
provided
in
chapter
142C.
8
(6)
Instruction
providing
an
awareness
about
9
sharing
the
road
with
bicycles
and
motorcycles.
10
b.
The
content
of
the
course
of
instruction
11
required
under
this
subsection
shall
be
equivalent
12
to
that
required
under
section
321.178.
However,
13
reference
and
study
materials,
physical
classroom
14
requirements,
and
extra
vehicle
safety
equipment
15
required
for
instruction
under
section
321.178
shall
16
not
be
required
for
the
course
of
instruction
provided
17
under
this
section.
18
4.
Course
completion
and
certification.
Upon
19
application
by
a
student
for
an
intermediate
license,
20
the
teaching
parent
shall
provide
evidence
showing
21
the
student’s
completion
of
an
approved
course
and
22
substantial
compliance
with
the
requirements
of
23
subsection
3
by
affidavit
signed
by
the
teaching
24
parent
on
a
form
to
be
provided
by
the
department.
The
25
evidence
shall
include
all
of
the
following:
26
a.
Documentation
that
the
instructor
is
a
teaching
27
parent
as
defined
in
subsection
2.
28
b.
Documentation
that
the
student
is
receiving
29
competent
private
instruction
under
section
299A.2
30
or
the
name
of
the
school
district
within
which
the
31
student
is
receiving
instruction
under
section
299A.3.
32
c.
The
name
of
the
approved
course
completed
by
the
33
student.
34
d.
An
affidavit
attesting
to
satisfactory
35
completion
of
course
work
and
street
or
highway
driving
36
instruction.
37
e.
Copies
of
written
tests
completed
by
the
38
student.
39
f.
A
statement
of
the
number
of
classroom
hours
of
40
instruction.
41
g.
A
log
of
completed
street
or
highway
driving
42
instruction
including
the
dates
when
the
lessons
were
43
conducted,
the
student’s
and
the
teaching
parent’s
name
44
and
initials
noted
next
to
each
entry,
notes
on
driving
45
activities
including
a
list
of
driving
deficiencies
and
46
improvements,
and
the
duration
of
the
driving
time
for
47
each
session.

5.
Intermediate
license.
Any
student
who
49
successfully
completes
an
approved
course
as

section,
passes
a
driving
test
to

be
administered
by
the
department,
and
is
otherwise

qualified
under
section
321.180B,
subsection
2,
shall

be
eligible
for
an
intermediate
license
pursuant

to
section
321.180B.
Twenty
of
the
forty
hours
of
5
street
or
highway
driving
instruction
required
under
6
subsection
3,
paragraph
“a”
,
subparagraph
(2),
may
be
7
used
to
satisfy
the
requirement
of
section
321.180B,
8
subsection
2.
9
6.
Full
license.
A
student
must
comply
with
10
section
321.180B,
subsection
4,
to
be
eligible
for
a
11
full
driver’s
license
pursuant
to
section
321.180B.

Section
321.180B,
subsection
2,
paragraph
13
a,
Code
2013,
is
amended
to
read
as
follows:

a.
The
department
may
shall
issue
an
intermediate
15
driver’s
license
to
a
person
sixteen
or
seventeen
years
16
of
age
who
possesses
an
instruction
permit
issued
17
under
subsection
1
or
a
comparable
instruction
permit
18
issued
by
another
state
for
a
minimum
of
six
months
19
immediately
preceding
application,
and
who
presents
an
20
affidavit
signed
by
a
parent,
guardian,
or
custodian
21
on
a
form
to
be
provided
by
the
department
that
the
22
permittee
has
accumulated
a
total
of
twenty
hours
of
23
street
or
highway
driving
of
which
two
hours
were
24
conducted
after
sunset
and
before
sunrise
and
the
25
street
or
highway
driving
was
with
the
permittee’s
26
parent,
guardian,
custodian,
instructor,
a
person
27
certified
by
the
department,
or
a
person
at
least
28
twenty-five
years
of
age
who
had
written
permission
29
from
a
parent,
guardian,
or
custodian
to
accompany
30
the
permittee,
and
whose
driving
privileges
have
not
31
been
suspended,
revoked,
or
barred
under
this
chapter
32
or
chapter
321J
during,
and
who
has
been
accident
33
and
violation
free
continuously
for,
the
six-month
34
period
immediately
preceding
the
application
for
an
35
intermediate
license.
An
applicant
for
an
intermediate
36
license
must
meet
the
requirements
of
section
37
321.186
,
including
satisfactory
completion
of
driver
38
education
as
required
in
section
321.178
or
321.178A
,
39
and
payment
of
the
required
license
fee
before
an
40
intermediate
license
will
be
issued.
A
person
issued
41
an
intermediate
license
must
limit
the
number
of
42
passengers
in
the
motor
vehicle
when
the
intermediate
43
licensee
is
operating
the
motor
vehicle
to
the
number
44
of
passenger
safety
belts.
