Page 2, before line 18 by inserting: 7 < Sec. ___. Section 476C.3, subsection 5, Code 8 Supplement 2011, is amended to read as follows: 9 5. a. The board shall maintain a waiting list of 10 facilities that may have been found eligible under 11 this section but for the maximum capacity restrictions 12 of subsection 4 . The priority of the waiting list 13 shall be maintained in the order the applications were 14 received by the board. The board shall remove from the 15 waiting list any facility that has subsequently been 16 found ineligible under this chapter . If additional 17 capacity becomes available within the capacity 18 restrictions of subsection 4 , the board shall grant 19 approval to facilities according to the priority 20 of the waiting list before granting approval to new 21 applications. An owner of a facility on the waiting 22 list shall provide the board each year by August 31 23 with a sworn statement of verification stating that 24 the information contained in the application for 25 eligibility remains true and correct or stating that 26 the information has changed and providing the new 27 information. 28 b. Notwithstanding paragraph “a” , if a facility 29 that has received approval pursuant to section 30 476B.5 is not operational due to the maximum capacity 31 restrictions of section 476B.5, subsection 4, and 32 if additional capacity becomes available within the 33 capacity restrictions of subsection 4 of this section 34 attributable to a facility that was granted approval 35 prior to December 31, 2011, either losing approval 36 or voluntarily relinquishing eligibility, the first 37 twenty megawatts of such additional capacity shall be 38 allocated to and shall increase the maximum amount of 39 capacity specified in section 476B.5, subsection 4. > 40 3.
