Notwithstanding
this
chapter
or
any
provision

law
to
the
contrary,
the
following
entities
may

establish
and
operate
an
alternative
charter
school

pursuant
to
this
section:

a.
The
board
of
directors
of
a
school
district.
11
b.
A
consortium
consisting
of
the
boards
of
12
directors
of
two
or
more
school
districts.

c.
An
area
education
agency
board.
14
d.
A
consortium
consisting
of
the
boards
of
15
directors
of
an
area
education
agency
and
one
or
more
16
school
districts,
at
least
one
of
which
is
located
17
within
the
boundaries
of
the
area
education
agency.
18
e.
The
board
of
directors
of
a
community
college.
19
f.
A
consortium
consisting
of
the
boards
of
20
directors
of
a
community
college
and
one
or
more
school
21
districts,
at
least
one
of
which
is
located
within
the

boundaries
of
the
community
college.

An
institution
of
higher
education

Within
thirty
days
of
establishing
an

alternative
charter
school
pursuant
to
this
section,
40
the
entity
establishing
the
alternative
charter
school
41
shall
submit
to
the
department
of
education,
and
42
publish
on
an
internet
site
operated
by
the
entity,
43
a
copy
of
the
plan
of
operation
for
the
alternative
44
charter
school,
which
shall
include
but
is
not
limited
45
to
the
following:
46
a.
The
alternative
charter
school’s
budget.
47
b.
The
methods
by
which
academic
achievement
will
48
be
measured.
49
c.
The
measures
that
will
be
used
to
assure
that
at

least
ninety-five
percent
of
the
students
enrolled
in
1
the
school
will
demonstrate
a
minimum
of
one
year
of

academic
growth
for
each
year
of
instruction.

Assurance
that
the
alternative
charter
school

shall,
at
a
minimum,
administer
the
Iowa
test
of
basic
5
skills
and
the
Iowa
tests
of
educational
development
in
6
the
manner
and
frequency
used
by
the
majority
of
school
7
districts
in
this
state.

e.
The
admissions
procedures
and
dismissal
9
procedures,
including
the
school’s
code
of
student
10
conduct.
11
f.
The
measures
to
be
employed
to
ensure
that
12
the
school’s
racial
and
ethnic
balance
reflects
the
13
community
it
serves
or
reflects
the
racial
and
ethnic
14
range
of
other
schools
located
within
the
boundaries
of
15
the
school
district
in
which
the
school
is
located.

g.
The
manner
in
which
the
school
will
be
insured.

h.
The
qualifications
to
be
required
of
the

alternative
charter
school’s
teachers.

The
educational
goals
of
the
entity
and
the

alternative
charter

3.
Although
an
alternative
charter
school
may
elect
22
to
comply
with
one
or
more
provisions
of
statute
or
23
administrative
rule,
an
alternative
charter
school
is
24
exempt
from
all
statutes
and
rules
applicable
to
a
25
school,
a
school
board,
or
a
school
district,
including
26
but
not
limited
to
chapters
20
and
279,
except
as
27
provided
in
subsections
4,
5,
and
8.

4.
An
alternative
charter
school
shall
meet
29
all
applicable
state
and
local
health
and
safety
30
requirements.

5.
An
alternative
charter
school
shall
not
32
discriminate
in
its
student
admissions
policies
or
33
practices
on
the
basis
of
a
student’s
intellectual
or
34
athletic
ability,
measures
of
achievement
or
aptitude,
35
or
status
as
a
person
with
a
disability.
However,
36
an
alternative
charter
school
may
limit
admission
to
37
students
who
are
within
a
particular
range
of
ages
or
38
grade
levels
or
on
any
other
basis
that
would
be
legal
39
if
initiated
by
a
school
district.

6.
The
alternative
charter
school
shall
make
an
41
annual
progress
report
to
the
department
by
a
date
42
specified
by
the
department.
The
report
shall
contain
43
but
not
be
limited
to
the
school’s
progress
toward
44
achieving
the
goals
outlined
in
its
operation
plan
and
45
the
financial
records
of
the
school,
including
revenues
46
and
expenditures.
47
7.
The
cost
of
educating
students
enrolled
in
an
48
alternative
charter
school
shall
be
paid
in
the
same
49
manner
as
for
students
enrolled
in
school
districts
as

and

An
alternative
charter
school
shall
utilize
2
facilities
that
comply
with
the
state
building
code
3
adopted
pursuant
to
section
103A.7
and
with
the
rules

adopted
for
schools
by
the
fire
marshal
pursuant
to
5
section
100.35.
