Section 279.19, Code 2011, is amended to 3 read as follows: 4 279.19 Probationary period. 5 1. The For a teacher first employed by a school 6 district on or after July 1, 2012, the first three five 7 consecutive years of employment of a the teacher in the 8 same that school district are a probationary period. 9 However, if the teacher has successfully completed a 10 probationary period of employment for another school 11 district located in Iowa, the probationary period in 12 the current district of employment shall not exceed one 13 year. A board of directors may waive the probationary 14 period for any teacher who previously has served a 15 probationary period in another school district and 16 the board may extend the probationary period for an 17 additional year with the consent of the teacher. 18 2. In the case of the termination of a probationary 19 teacher’s contract, the provisions of sections 279.15 20 and 279.16 shall apply. However, if the probationary 21 teacher is a beginning teacher who fails to demonstrate 22 competence in the Iowa teaching standards in accordance 23 with chapter 284 , the provisions of sections 279.17 and 24 279.18 shall also apply. 25 3. The board’s decision shall be final and binding 26 unless the termination was based upon an alleged 27 violation of a constitutionally guaranteed right of 28 the teacher or an alleged violation of public employee 29 rights of the teacher under section 20.10 . 30 4. Notwithstanding any provision to the contrary, 31 the grievance procedures of section 20.18 relating to 32 job performance or job retention shall not apply to a 33 teacher during the first two years of the teacher’s 34 probationary period. However, except as provided in 35 section 284.8, this paragraph subsection shall not 36 apply to a teacher who has successfully completed a 37 probationary period in a school district in Iowa. 38 Sec. ___. Section 279.24, subsection 4, Code 2011, 39 is amended to read as follows: 40 4. Administrators employed in a school district for 41 less than two five consecutive years are probationary 42 administrators. However, a school board may waive 43 the probationary period for any administrator who has 44 previously served a probationary period in another 45 school district and the school board may extend the 46 probationary period for an additional year with the 47 consent of the administrator. notify the administrator not later than May 15 that 1 the contract will not be renewed beyond the current 2 year. The notice shall be in writing by letter, 3 personally delivered, or mailed by certified mail. The 4 notification shall be complete when received by the 5 administrator. Within ten five days after receiving 6 the notice, the administrator may request a private 7 conference with the school board to discuss the 8 reasons for termination. The school board’s decision 9 to terminate a probationary administrator’s contract 10 shall be final unless the termination was based upon 11 an alleged violation of a constitutionally guaranteed 12 right of the administrator. > 13 2.
