Senate File 2254 S-5076 Amend Senate File 2254 as follows: 1 1. By striking everything after the enacting clause 2 and inserting: 3 < Section 1. Section 483A.24, subsections 3 and 4, 4 Code Supplement 2011, are amended to read as follows: 5 3. The director shall provide up to seventy-five 6 nonresident deer hunting licenses for allocation as 7 provided in this subsection. 8 a. Thirty-five of the nonresident deer hunting 9 licenses shall be allocated as requested by a majority 10 of a committee consisting of the majority leader of 11 the senate, speaker of the house of representatives, 12 and director of the economic development authority, or 13 their designees. The licenses provided pursuant to 14 this subsection shall be in addition to the number of 15 nonresident licenses authorized pursuant to section 16 483A.8 . The purpose of the special nonresident 17 licenses is to allow state officials and local 18 development groups to promote the state and its natural 19 resources to nonresident guests and dignitaries. 20 Photographs, videotapes, or any other form of media 21 resulting from the hunting visitation shall not be 22 used for political campaign purposes. The nonresident 23 licenses shall be issued without application upon 24 payment of the nonresident deer hunting license fee and 25 the wildlife habitat fee. The licenses are valid in 26 all zones open to deer hunting. The hunter safety and 27 ethics education certificate requirement pursuant to 28 section 483A.27 is waived for a nonresident issued a 29 license pursuant to this subsection . 30 b. Forty of the nonresident deer hunting licenses 31 shall be allocated as provided in subsection 4A. 32 4. The director shall provide up to twenty-five 33 seventy-five nonresident wild turkey hunting licenses 34 for allocation as provided in this subsection. 35 a. Thirty-five of the nonresident wild turkey 36 hunting licenses shall be allocated as requested 37 by a majority of a committee consisting of the 38 majority leader of the senate, speaker of the house 39 of representatives, and director of the economic 40 development authority, or their designees. The 41 licenses provided pursuant to this subsection shall 42 be in addition to the number of nonresident licenses 43 authorized pursuant to section 483A.7 . The nonresident licenses shall be issued without 1 application upon payment of the nonresident wild 2 turkey hunting license fee and the wildlife habitat 3 fee. The licenses are valid in all zones open to wild 4 turkey hunting. The hunter safety and ethics education 5 certificate requirement pursuant to section 483A.27 is 6 waived for a nonresident issued a license pursuant to 7 this subsection . 8 b. Forty of the nonresident wild turkey hunting 9 licenses shall be allocated as provided in subsection 10 4A. 11 Sec. 2. Section 483A.24, Code Supplement 2011, is 12 amended by adding the following new subsection: 13 NEW SUBSECTION . 4A. Forty of the nonresident deer 14 hunting licenses and wild turkey hunting licenses 15 allocated under subsections 3 and 4 shall be available 16 for issuance to nonresidents who have served in the 17 armed forces of the United States on active federal 18 service and who were disabled during the veteran’s 19 military service or who are serving in the armed forces 20 of the United States on active federal service and 21 have been disabled during military service to enable 22 the disabled person to participate in a hunt that is 23 conducted by an organization that conducts hunting 24 experiences in this state for disabled persons. The 25 licenses shall be issued as follows: 26 a. The department shall prepare an application to 27 be used by a person requesting a special license under 28 this subsection. 29 (1) The department shall verify that the license 30 will be used by the applicant in connection with 31 a hunt conducted by an approved organization that 32 conducts hunting experiences in this state for disabled 33 veterans and members of the armed forces serving on 34 active federal service who have been disabled during 35 military service. The department shall specify, by 36 rules adopted under chapter 17A, what requirements 37 an organization must meet in order to be approved to 38 conduct hunts for disabled persons who obtain licenses 39 under this subsection. 40 (2) The department of veterans affairs shall assist 41 the department in verifying the status or claims of 42 applicants under this subsection. As used in this 43 subsection, “disabled” means entitled to a service 44 connected rating under 38 U.S.C. ch. 11 with a degree 45 of disability of thirty percent or more. 46 b. A license issued under this subsection shall be 47 in addition to the number of nonresident wild turkey 48 hunting licenses authorized pursuant to section 483A.7 49 and nonresident deer hunting licenses authorized 50 -2- SF2254.4877 (1) 84 av/nh 2/ 3
pursuant to section 483A.8. However, a nonresident 1 who obtains a license pursuant to this subsection is 2 not eligible to obtain a nonresident deer hunting 3 license or wild turkey hunting license under any other 4 provision of law. 5 c. A disabled person who receives a special license 6 under this subsection shall purchase a hunting license, 7 and a wild turkey hunting license or a deer hunting 8 license, if applicable, and pay the wildlife habitat 9 fee, all for the same fee that is charged to resident 10 hunters. If hunting deer, the disabled person shall 11 also pay a one dollar fee that shall be used and is 12 appropriated for the purpose of deer herd population 13 management, including assisting with the cost of 14 processing deer donated to the help us stop hunger 15 program administered by the commission. 16 0d. A special hunting license shall be available 17 for issuance under this subsection to a disabled 18 veteran or disabled member of the armed forces serving 19 on active federal service for the same fee that is 20 charged to a resident hunter to enable such a disabled 21 person to participate in a hunt conducted by an 22 organization approved under this subsection for which 23 only a hunting license is required. 24 d. A disabled person who receives a special license 25 under this subsection shall complete the hunter safety 26 and ethics education course. 27 e. A license issued under this subsection is valid 28 for use only on a hunt conducted by an organization 29 approved under this subsection. 30 f.
