(1) Is a resident of Iowa; is, 20 notwithstanding subsection 3, paragraph “c” , under the 21 age of twenty-six; is not a convicted felon as defined 22 in section 910.15; and meets the following criteria: 23 (a) Is the child of a peace officer, as defined 24 in section 97A.1, who is permanently and totally 25 disabled and who receives benefits under section 26 97A.6, subsection 5, or was killed in the line of duty 27 as determined by the board of trustees of the Iowa 28 department of public safety peace officers’ retirement, 29 accident, and disability system in accordance with 30 section 97A.6, subsection 16. 31 (b) Is the child of a police officer or a 32 fire fighter, as defined in section 411.1, who is 33 permanently and totally disabled and who receives 34 benefits under section 411.6, subsection 5, or 35 was killed in the line of duty as determined by 36 the statewide fire and police retirement system in 37 accordance with section 411.6, subsection 15. 38 (c) Is the child of a person described as a peace 39 officer under section 97B.49B or is the child of 40 a sheriff or deputy sheriff as defined in section 41 97B.49C, who is permanently and totally disabled and 42 who receives an in-service disability retirement 43 allowance under section 97B.50A, subsection 2, or is 44 killed in the line of duty as determined by the Iowa 45 public employees’ retirement system in accordance with 46 section 97B.52, subsection 2. 47 (2) If a student receives financial aid under any 48 other federal, state, or institutional scholarship or 49 grant program, the full amount of the other financial 50 -1- S3287.3193 (4) 84 kh/tm 1/ 3 #1. #2. #3.
aid shall be applied to the student’s expenses first 1 and shall be considered part of the student’s available 2 financial resources in determining the amount of the 3 student’s award under this paragraph “d”. The total 4 financial aid for the student’s education, including 5 financial aid under any other program, shall not exceed 6 the student’s cost of attendance at the institution 7 which the student attends. 8 (3) For purposes of this paragraph “d” : 9 (a) “Approved postsecondary education or training 10 program” means a program offered by an Iowa community 11 college or institution of higher education governed by 12 the state board of regents. 13 (b) “Permanently and totally disabled” means the 14 individual is unable to engage in any substantial 15 gainful activity by reason of a medically determinable 16 physical impairment which can be expected to last 17 for a continuous period or can be expected to result 18 in death. A certificate from a qualified physician 19 attesting to the individual’s permanent and total 20 disability must be submitted to the commission. The 21 certificate must include the name and address of 22 the physician and contain an acknowledgment that the 23 certificate will be used by the individual to qualify 24 for educational assistance pursuant to this section. > 25 4. receives state assistance under section 256.57, or 1 financial support from a city or county pursuant 2 to section 256.69, to dispose of, through sale, 3 conveyance, or exchange, any library materials that may 4 be obsolete or worn out or that may no longer be needed 5 or appropriate to the mission of the public library. 6 These materials may be sold by the public library 7 directly or the governing body of the public library 8 may sell the materials by consignment to a public 9 agency or to a private agency organized to raise funds 10 solely for support of the public library. Proceeds 11 from the sale of the library materials may be remitted 12 to the public library and may be used by the public 13 library for the purchase of books and other library 14 materials or equipment, or for the provision of library 15 services. > 16 14.
