Section 707.7, subsections 1, 2, and 4, 5 Code 2011, are amended to read as follows: 6 1. Any person who intentionally terminates a human 7 pregnancy, with the knowledge and voluntary consent 8 of the pregnant person, after the end of the second 9 trimester of the pregnancy a gestation period of 10 twenty completed weeks where death of the fetus results 11 commits feticide. Feticide is a class ā€œCā€ felony. 12 2. Any person who attempts to intentionally 13 terminate a human pregnancy, with the knowledge and 14 voluntary consent of the pregnant person, after the end 15 of the second trimester of the pregnancy a gestation 16 period of twenty completed weeks where death of the 17 fetus does not result commits attempted feticide. 18 Attempted feticide is a class ā€œDā€ felony. 19 4. This section shall not apply to the termination 20 of a human pregnancy performed by a physician licensed 21 in this state to practice medicine or surgery or 22 osteopathic medicine or surgery when in the best 23 clinical judgment of the physician the termination 24 is performed to preserve the life or health of the 25 pregnant person or of the fetus and every reasonable 26 medical effort not inconsistent with preserving the 27 life of the pregnant person is made to preserve the 28 life of a viable the fetus. 29 Sec. 2. EFFECTIVE UPON ENACTMENT. This Act, being 30 deemed of immediate importance, takes effect upon 31 enactment. > 32 2.
