Senate Resolution 7 S-3219 Amend Senate Resolution 7 as follows: 1 1. By striking page 1, line 1, through page 3, line 2 3, and inserting: 3 < A Resolution urging the nullification of rules 4 adopted by the United States Environmental Protection 5 Agency relating to national emissions standards for 6 hazardous air pollutants for reciprocating internal 7 combustion engines. 8 WHEREAS, the United States Environmental 9 Protection Agency in March 2000 finalized national 10 emissions standards for hazardous air pollutants for 11 reciprocating internal combustion engines which took 12 effect in May 2010; and 13 WHEREAS, the rules would have a devastating impact 14 on Iowa’s municipal utilities due to the fact that the 15 municipal utilities collectively operate 287 diesel 16 electric generators with a combined nameplate capacity 17 of 548 megawatts; and 18 WHEREAS, these rules impact 67 utilities that serve 19 a total of 106,000 customers with an average of 1,560 20 customer meters per utility; and 21 WHEREAS, Iowa’s municipal electric utilities 22 operate diesel generators both to be able to keep the 23 lights on when transmissions lines are downed by ice, 24 wind, floods, or other natural disasters or man-made 25 emergencies, and to meet the obligation to own or buy 26 reserve capacity; and 27 WHEREAS, the rules allow a municipal electric 28 utility to run diesel generators in an emergency, but 29 effectively take away the ability of a small community 30 to afford them by prohibiting the receipt of payment or 31 credit for reserve capacity; and 32 WHEREAS, the diesel generators run only a few hours 33 a year, with averages ranging from 14 to 46 hours 34 depending on power supply arrangements; and 35 WHEREAS, the application of the rules requires that 36 each of these engines either be retrofit, replaced, 37 or removed, resulting in huge cost increases to the 38 citizen owners of these utilities in the form of rate 39 increases and lost capacity; and 40 WHEREAS, the cost estimate if all 287 diesel 41 generators were to be retrofit for compliance over a 42 10-year period is $36 million, which is an average cost 43 of $34.14 per year per customer with costs as high 44 as $203 per year per customer or more, and such cost 45 estimates would increase beyond this amount if diesel 46 generators are replaced or taken out of service; NOW 47 THEREFORE, 48 BE IT RESOLVED BY THE SENATE, That the United States 49 Environmental Protection Agency is urged to rescind 50 -1- SR7.2261 (2) 84 tm/nh 1/ 2 #1.
