Section 717B.3A, subsection 3, paragraph 4 a, subparagraphs (1) and (2), Code 2011, are amended 5 to read as follows: 6 (1) For the first or a subsequent conviction, the 7 person is guilty of an aggravated misdemeanor a class 8 “D” felony . The sentencing order shall provide that 9 the person submit to psychological evaluation and 10 treatment according to terms required by the court. 11 The costs of the evaluation and treatment shall be 12 paid by the person. In addition, the sentencing order 13 shall provide that the person complete a community 14 work requirement, which may include a work requirement 15 performed at an animal shelter or pound, as defined 16 in section 162.2 , according to terms required by the 17 court. 18 (2) For a second or subsequent conviction, 19 the person is guilty of a class “D” felony. The 20 sentencing order shall provide that the person submit 21 to psychological evaluation and treatment according 22 to terms required by the court.
