NEW SECTION . 135P.1 Recordings at 4 pregnancy termination locations. 5 As used in this chapter, unless the context 6 otherwise requires: 7 1. “Pregnancy termination location” means a 8 hospital, clinic, or other facility where a health care 9 provider who induces a termination of pregnancy is 10 required to file a report with the department of public 11 health as provided in chapter 144. 12 2. “Record” means the same as defined in section 13 717A.1. 14 Sec. ___. NEW SECTION . 135P.2 Pregnancy 15 termination location —— interference. 16 A person is guilty of pregnancy termination location 17 interference, if the person acts without the consent 18 of the owner of a pregnancy termination location to 19 willfully do any of the following: 20 1. Produce a record which reproduces an image or 21 sound occurring at the medical facility as follows: 22 a. The record must be created by the person while 23 at the medical facility. 24 b. The record must be a reproduction of a visual or 25 audio experience occurring at the pregnancy termination 26 location, including but not limited to a photographic 27 or audio medium. 28 2. Possess or distribute a record which reproduces 29 an image or sound occurring at the pregnancy 30 termination location which was produced as provided in 31 subsection 1. 32 Sec. ___. NEW SECTION . 135P.3 Pregnancy 33 termination location interference —— penalties. 34 1. A person who commits the offense of pregnancy 35 termination location interference is guilty of the 36 following: 37 a. For the first conviction, the person is guilty 38 of an aggravated misdemeanor. 39 b. For the second or subsequent conviction, the 40 person is guilty of a class “D” felony. 41 2. A person who commits the offense of pregnancy 42 termination location interference is subject to an 43 order of restitution as provided in chapter 910. > 44 2.
